In Katei v County Government of Makueni, the court refused to reinstate dismissed interim applications. That ruling did not finally reject the petition or determine the petitioners’ claimed rights to compensation.
The petition challenged a Sultan Hamud planning notice
The petitioners contested a county notice affecting Sultan Hamud town. Their main prayers alleged constitutional defects, lack of public participation and interference with property rights without sufficient justification or compensation. They also requested preservation of their properties. Those were claims awaiting substantive determination, rather than established findings in the March 2026 ruling.
Alongside the petition, they had sought temporary restraint against implementation of the notice. Another application concerned joinder and maintenance of the status quo. The joinder prayer had already been allowed, leaving temporary protection as the outstanding question. Several remaining prayers repeated relief sought in the main petition.
The advocates withdrew, and the applicants missed the hearing
The record described an extended period without prosecution of the applications. At one stage, the petitioners’ advocates sought instructions about terminating the petition. They subsequently obtained permission to cease acting. The court directed service of the hearing notice upon the applicants themselves.
The two applications were dismissed for non-attendance at the May 2025 hearing. The petitioners later applied to set aside those dismissal orders and obtain a status-quo order. They argued that email service did not comply with the direction for personal service and that the first applicant had not received the notice.
The court accepted the service shown on this record
The county opposed reinstatement. It relied on service through the same email address previously used when the former advocates applied to withdraw. The judge accepted that history and rejected the applicants’ assertion that they had not received the hearing notice.
This is a finding about the actual service evidence and procedural history before the judge. It is not a blanket statement that any email to any address satisfies every service direction. For another dispute, the wording of the order, the address used, proof of delivery and the surrounding record require separate examination.
Reinstatement would not resolve the main dispute
The court considered what remained in the dismissed applications. Apart from temporary protection, the prayers largely duplicated the petition. It also noted that no adverse event had occurred since filing to justify the renewed focus on interlocutory applications, and that the petitioners had previously contemplated ending the proceedings.
The judge concluded that the applicants had not demonstrated grounds for a favourable exercise of discretion. The reinstatement application was dismissed with costs to the county. The reasons encouraged determination of the main petition instead of further attention to applications that would not advance its speedy disposal.

An advocate confirms availability, scope and fees before accepting your matter. The petition was still alive
The March ruling did not declare the development notice lawful, dismiss the entire petition or award compensation. It also did not grant the requested status-quo protection. A live-file review must check later directions and orders before assuming either that development is restrained or that the constitutional property claims have failed.
The published text contains inconsistent dates for some earlier applications and submissions. This analysis relies on the clearly identified sequence and operative dismissal, rather than inventing a corrected chronology. Keep the original filed documents and hearing orders when assessing deadlines or service.
Prepare a procedural file alongside the planning evidence
An advocate reviewing Sultan Hamud property proceedings in Makueni needs the challenged notice, property records, petition, application papers and complete order history. Add the withdrawal application, service directions, email records and dismissal order. These documents address different questions: the underlying planning complaint and the explanation for missing a hearing.
Does refusing reinstatement settle compensation?
No. This ruling resolved a procedural application. It did not determine the merits of the compensation allegation in the surviving petition. The next assessment should follow the current court record and the relief actually sought.
