A Migori property advocate or land lawyer reviewing litigation costs must distinguish the amount claimed in a bill from the amount allowed on taxation. In Ocharo v Ojowi, the defendants challenged what they considered an inadequate assessment after a market-plot suit was dismissed. The court found no error of principle and refused to increase the taxed items.

The underlying dispute concerned a market plot

The original litigation concerned ownership and use of Marindi Market Plot No. 2 in Suna West, Migori County. The pleadings sought permanent injunctions, demolition and other relief. The suit was dismissed in December 2022 following a notice to show cause.

The later application did not retry that ownership dispute. It asked the judge to review the taxing officer’s April 2023 assessment of a defendants’ bill of costs. Reporting it as a new judgment awarding the market plot would confuse the two proceedings.

The claimed bill was much larger than the taxed amount

The applicants said their KSh 1,035,437 bill had been assessed at KSh 125,550. They challenged instruction fees, getting-up fees and several drawing, perusal, attendance and service items.

The claimed instruction fee in the bill was KSh 665,000. In argument, the applicants suggested that instruction fees should be no less than KSh 500,000. Those were requested figures, not sums awarded by the court.

The judge required an identified error of principle

At paragraphs 11–17, the court explained the limited basis for interfering with a taxing officer’s discretion. A reference needs to identify a misapplied rule, omitted material factor or result of the kind justifying intervention.

The court did not treat the judge’s own preference for another amount as sufficient. The supervisory task was to correct demonstrated error rather than repeat the entire assessment because a party disliked its outcome.

The proposed value had no supporting basis

At paragraphs 19–22, the judge found no ascertainable monetary value in the pleadings and no valuation report or supporting documentary evidence for the figure proposed. The nature of a property dispute alone did not establish the asserted value.

The court upheld KSh 75,000 instruction fees as a reasonable assessment within the taxing officer’s discretion. That figure was one component of the taxed bill. It was not the value of the market plot, a damages award or a universal fee for retaining an advocate.

The hearing history affected the getting-up item

Paragraph 23 noted that the suit had been dismissed after the notice to show cause and had not been heard on the merits. On the record of this case, the judge upheld disallowance of getting-up fees.

A review should examine the actual hearing directions and preparation record. This ruling should not be reduced to a blanket proposition that every matter resolved before witnesses testify defeats that fee. The court was applying the remuneration provisions to the particular procedural history before it.

The remaining objections also failed

At paragraph 24, the judge found no demonstrable fault in the taxing officer’s treatment of the other items. The reference was dismissed entirely at paragraph 27, with each party bearing its own costs of that application.

The respondents had not filed opposing evidence or submissions, but that absence did not automatically establish the applicants’ entitlement to increased costs. The court still examined whether the grounds for intervention were shown.

Documents for a costs-review enquiry

Someone searching for an advocate for land litigation costs in Migori should supply the bill, taxation ruling, reasons, underlying pleadings and final order. Identify the particular item challenged and the evidence supporting its claimed amount.

Also distinguish recoverable litigation costs from an advocate-client fee agreement. The amount taxed against an opposing party does not, by itself, establish all private fees owed under a retainer. The relevant documents and applicable procedure require separate review.
