A container charge indemnity lawyer or advocate in Mombasa needs to examine both the original payment and the procedural steps taken to bring the other company into the case. Proving that money left an account and obtaining judgment against the party said to owe an indemnity are distinct parts of the dispute.
What the Turning Point appeal decided
The High Court allowed the appeal and entered judgment for KSh 297,000 against the second respondent, the third party in the lower proceedings. It awarded trial and appeal costs to the appellant and first respondent against that party. The duly served third-party notice had not been answered. The decision turned on the third-party procedure; it should not be read as a finding that every leaking or damaged container charge is automatically recoverable from a shipping agency.
Identify the charge and its contractual basis
Bring the invoice, replacement demand, receipt and documents identifying the container. Explain whether the payment concerned replacement, repair, detention or another charge. Similar words in correspondence can conceal different obligations, and an advocate needs to know which sum is actually being reclaimed.
Match the container number across the shipping documents, release records and payment trail. If several consignments were handled together, isolate the relevant one. A general account statement may not show which charge relates to the disputed incident or who accepted responsibility for it.
Provide the transport, clearing and shipping instructions. Identify the importer, agent and company issuing the demand. The person who paid may have done so under instructions from someone else; that payment alone does not explain the contractual relationship between all the businesses involved.
Preserve the incident evidence
Retain inspection reports, photographs and correspondence about the container's condition. Note when the damage or leakage was reported and who inspected it. Avoid replacing an original report with a later narrative prepared solely for the dispute.
Explain what happened before and after delivery. The advocate should know who had custody, when the container was returned and whether the parties disagreed about the cause. A chronological record helps distinguish an actual indemnity issue from an unsupported assumption about responsibility.
Keep any admission or promise to reimburse in its full context. Identify the author and their role. A message from an operational contact may need further explanation before it can be treated as an authorised undertaking by the company named as a proposed defendant.

Produce the receipt and bank record together where possible. State who paid, whose account was debited and who received the money. If the clearing agent advanced funds for the importer, supply the instructions and any later settlement between those two parties.
Make the requested amount understandable. Separate the container replacement payment from legal costs, interest or additional operational losses. Ask the lawyer to assess each category rather than assuming every cost appearing in the file forms part of the same recoverable debt.
Check whether any refund, credit note or insurer payment has already been received. Show how it affects the remaining claim. An indemnity dispute should be built around the net sum and the relevant obligation, with a clear record of adjustments.
Bring another party into the proceedings properly
Give the advocate the complete claim, response and third-party papers if a case is already underway. Identify the relief sought against the additional party and the relationship relied on. Naming a company in correspondence is different from formally bringing it into proceedings.
Preserve the notice, service affidavit and any appearance or response. Service and participation may become central issues. Do not infer that silence outside court is equivalent to failure to answer a properly served court document.
Record any directions made by the adjudicator about the third-party claim. Ask which procedural step is available at the present stage. The Turning Point judgment should be assessed against the actual notice and court record, rather than used as a shortcut around service or proof requirements.
If an appeal is contemplated, preserve the lower court record and identify the alleged legal error. A lawyer needs to distinguish a procedural ground from a request to retry factual questions. Obtain advice on the applicable deadlines using the actual judgment and service history.
For a consultation in Mombasa, bring the charge documents, payment trail, instructions, incident records and complete third-party file. An advocate can assess the reimbursement obligation and the procedural route that fits the stage reached in your case.
