The cross-border delivery has been completed, but the customer says earlier transfers and credit notes already cover the remaining generator and fuel invoices. A freight invoice debt lawyer or advocate in Mombasa should reconcile the individual charges before proposing a recovery claim. The important question is not only whether containers reached their destination, but which authorised services remain unpaid after the adjustments are applied.

What the Kenfreight judgment decided

In the Mombasa High Court file, the court awarded US$126,165.91 to the logistics provider, dismissed the defence and counterclaim, and assessed costs at US$1,422. The operative order includes interest from 28 May 2020. The claim was treated as unpaid contractual consideration rather than damages for unperformed services. The signed delivery location is Nyeri. The website's summary label says dismissed, but the signed orders show the provider succeeded; those orders govern this account.

Connect each additional charge to instructions

Bring the quotation, accepted terms and email approvals for the particular consignment. Identify whether generator hire, fuel, delay or other incidental services were included in the original price or approved later. A broad instruction to transport goods may not explain every additional item on a final statement.

Match the instruction to the truck or container concerned and the period of service. If approvals were sent in stages, keep the sequence intact. The advocate should be able to trace the charge without guessing which email or operational event an invoice refers to.

Identify who issued the approval and the capacity in which they acted. Where a customer used an intermediary, provide the correspondence showing that relationship. A recipient being copied on an email does not by itself explain whether that person approved the additional expenditure.

Show performance as well as billing

Preserve delivery records, dispatch documents and evidence of the generator or fuel service. Different invoice lines may require different supporting records. An acknowledged delivery can support the main transport service while leaving an additional operational expense disputed.

Retain the records from subcontractors where relevant. Match their dates, units and amounts to the charge passed on to the customer. If an expense includes a margin or another contractual element, explain it openly so the calculation can be assessed against the agreed terms.

Record any contemporaneous objection from the customer. Identify whether it concerned performance, price, authorisation or the supporting documents. A later general refusal to pay should be considered alongside the earlier correspondence, rather than allowing the actual invoice dispute to disappear into a single total.

Reconcile transfers and credit notes carefully

Create a ledger listing every invoice, payment and credit note. Use one currency per calculation and show any conversion separately. Preserve the original records supporting the entries. A spreadsheet is useful for explaining the balance, but it should lead the reader to evidence for each adjustment.

Check whether the customer identified which invoices a transfer settled. If no allocation was supplied, explain how the payment was applied and whether that was communicated. Do not assume that a large transfer resolves every later charge or that an unidentified payment can be ignored.

Distinguish a credit note reducing an invoice from an actual cash refund. Record the invoice and reason to which the credit relates. Applying the same adjustment twice can distort both a recovery claim and an allegation of overpayment.

Include transactions after proceedings began. State the balance at filing and the current balance. If the pleaded amount differs from the reconciled amount, raise the difference with the advocate before presenting evidence. A smaller proved sum should not be hidden inside an unchanged demand.

Assess an overpayment defence or counterclaim

If the customer alleges an excess payment, ask for the complete calculation and supporting transfers. Identify whether the claim concerns this consignment or a different account. The adviser needs to assess both the provider's balance and the positive repayment claim, rather than treating one as an automatic answer to the other.

Provide the pleadings already filed and the evidence available for each disputed item. Explain any difference between an earlier statement and the position now proposed. A carefully drafted argument cannot replace missing transaction records or silently introduce a different factual case.

Keep interest, costs and the principal debt separate. The award in Kenfreight arose from its own record and orders; it does not supply an automatic interest start date for another freight account. Ask the lawyer to assess the applicable contractual and legal basis in your matter.

For a Mombasa freight debt consultation, bring a reconciled ledger, the approvals, performance documents and payment allocation history. An advocate can assess the remaining contractual consideration, any defensible set-off or counterclaim and the evidence needed for a focused recovery case.
