In Mombasa Trade Centre v East Africa Institute of Certified Studies & 2 others, the Mombasa ELC dismissed an application seeking committal for alleged disobedience during execution proceedings. The ruling illustrates why a Mombasa ELC lawyer reviewing enforcement must examine the order, the persons bound and evidence of deliberate breach.
The execution dispute behind the application
An earlier judgment had been entered for Mombasa Trade Centre in June 2023. In execution, motor vehicles were attached and advertised for sale. Equity Bank objected, claiming a priority legal interest in the attached vehicles.
In December 2024, the court allowed the bank’s objection, raised the attachment and ordered release of the identified vehicles. The later contempt application was brought by the judgment debtors, rather than by the bank that had obtained the objection orders.
What the contempt applicants wanted
The application of 18 November 2025 sought to cite the judgment creditor and two alleged contemnors for breach of earlier orders. It asked for committal to civil jail or attachment of assets to compensate for the alleged loss.
The respondents disputed the application, raising questions about the parties, service and the orders allegedly binding them. Those matters went directly to whether the serious sanction requested could be justified.
Why knowledge and deliberate breach required proof
The court discussed the heightened standard of proof applicable to contempt proceedings and the care required before committal to jail. The alleged disobedience needed evidence showing awareness of the order and deliberate conduct flouting it.
The supporting affidavit described service many months after the December 2024 order. The judge also questioned the connection of a person who was not a party to the suit. On the evidence presented, the court was not satisfied that the people accused had been made aware of the orders and deliberately disobeyed them.
The application failed; the earlier judgment was not overturned
The motion was dismissed with costs. That outcome did not set aside the original June 2023 judgment or decide every question about the bank’s security interest. It determined the contempt application before the court.
The public page labels the document as a judgment, but the official source is expressly headed “Ruling” and concerns this application. This analysis follows the substance and source text. Accurate procedural classification helps a reader understand what was actually won or lost.
How this relates to a property client’s court file
The immediate disputed assets in this ruling were motor vehicles attached in execution. It should not be described as a decision cancelling a land title or proving construction fraud. Its relevance is the enforcement stage within an ELC proceeding.
A property client may also encounter allegations that an injunction, preservation order or execution direction was ignored. The advocate’s task is to identify the exact order and evaluate the evidence of breach. The factual record and proposed remedy require review before seeking committal.

An advocate confirms availability, scope and fees before accepting your matter. The enforcement documents to collect
- The judgment, decree and exact order said to have been breached.
- The application and affidavits on which that order was made.
- Service records and other reliable evidence of knowledge.
- Documents linking each accused person to the relevant obligation.
- A dated description and evidence of the alleged non-compliance.
- Any later variation, stay or execution direction.
Keep the distinction between an obligation to release an asset, a disputed claim to that asset and a request for punishment. Combining all three into a broad allegation of contempt can conceal a gap in the evidence.
Frequently asked questions
Did the court commit anyone to civil jail?
No. It dismissed the contempt motion with costs.
Did dismissal cancel the earlier judgment?
No. The ruling determined the application concerning alleged disobedience.
Was this a land-fraud judgment?
No. The immediate issue was enforcement and alleged contempt involving attached vehicles.
Reviewing compliance with an ELC order
Give a Mombasa advocate the complete order and evidence of service or knowledge. That allows the review to address the actual obligation and alleged breach, rather than assume that an unsatisfied client’s account alone establishes contempt.
