An advocate confirms availability, scope and fees before accepting your matter.A transport supplier says your messages admit its whole invoice balance and asks the court to enter judgment without a trial. A haulage debt summary judgment lawyer or advocate in Mombasa should compare the alleged admission with the amount claimed and the disputed contract. The question at that stage is not simply whether the supplier has a convincing story, but whether genuine issues still need a hearing.
What the Nyasinga appeal decided
The High Court reversed the order striking out the defence and awarding KSh 3,539,504.80, and returned the claim to Mombasa Chief Magistrate's Court for trial. Contract existence and the difference between the alleged acknowledged amount and the claimed balance were triable issues. Appeal costs went against the supplier; motion costs awaited the suit's outcome. The court left WhatsApp admissibility and weight for trial. It did not declare the transport services unpaid, paid in full or permanently unrecoverable.
Connect the transport work to the contracting parties
Bring the transport agreement, orders and records of instructions for the disputed deliveries. Identify whether the company suing you dealt directly with your company or with another participant. Provide the documents supporting your position rather than relying only on a general denial of any business relationship.
Collect delivery notes, trip records and acknowledgment of completed services. Match each to the invoice it is said to support. A collection of transport documents may establish that work occurred while leaving the identity of the party obliged to pay open for investigation.
Explain any subcontracting arrangement and the role of intermediaries. Keep their instructions and payment arrangements separate. The advocate needs to identify which alleged obligation belongs to which participant before assessing whether the claim can be determined without a trial.
Reconcile the balance before discussing an admission
Make a table of invoices, credits and completed payments. Provide bank or cheque clearance evidence rather than treating an issued cheque as proof of a settled payment. Explain the allocation of each credit and any disputed entry.
If an email or message refers to a particular figure, compare that figure with the sum pleaded. Identify the period and invoices it concerns. A communication acknowledging one amount should not silently be expanded into an admission of every later charge or a different aggregate balance.
Keep claimed interest on a separate line with the contractual or other basis relied upon. A disputed rate may require different evidence from the principal account. Giving the advocate a transparent calculation helps identify which parts are potentially admitted and which genuinely remain contested.
Preserve the communications in their original context
Retain complete message threads, emails and attachments, including dates and identifying details. Explain whose device or account holds the record and how the copy was produced. Do not retype messages and present the new document as an original screenshot.
Identify the sender's position and any evidence of authority to speak for the company. A person discussing payment may have a role that requires examination before their words can be treated as binding an alleged debtor. Keep earlier and later messages that explain a conditional or partial statement.
Discuss electronic evidence requirements with the advocate for the actual procedural stage. An affidavit annexure and evidence produced at trial may raise different questions. This appeal did not settle every admissibility objection, so it should not be used to claim that WhatsApp records are always accepted or always excluded.

Provide the application seeking summary judgment or striking out, its supporting affidavit and all annexures. Mark each allegation you admit, dispute or cannot verify, and explain why. The lawyer should be able to connect a proposed defence to the records rather than rely on an unsupported refusal to pay.
Keep the procedural question distinct from the eventual merits. Showing that a contractual or accounting issue needs trial is not the same as proving your company owes nothing. Prepare the evidence for that later hearing while addressing the immediate application.
Include earlier withdrawn applications and recorded consents. They may matter to the file history, but do not assume that withdrawal automatically prevents every subsequent request. The adviser should assess the precise terms and the current application.
Prepare for what follows an appeal
Bring the formal appealed order, pleadings and record of proceedings. Identify any current enforcement notice or stay order. A successful appeal returning a case for trial does not necessarily dispose of every costs or scheduling issue, so read the final orders carefully.
Preserve witnesses and operational records while the proceedings continue. Staff changes or deleted transport records can make an eventual trial harder even where a premature judgment has been reversed. Ask the advocate which contested issues need documentary or oral proof.
For a Mombasa haulage debt consultation, provide the contract trail, delivery records, payment reconciliation and complete communications. A lawyer and advocate can assess whether summary disposal is appropriate and prepare the disputed issues for hearing without treating procedural success as a final finding on the debt.
