This article analyses Warda v Omar, decided by Mombasa Small Claims Court.
A repaid loan with an engine still withheld
Warda concerned a boat engine held in connection with a friendly loan. Mombasa Small Claims Court found the loan repaid and the continued detention and handing over of the engine inconsistent with the owner's rights. It awarded KSh 435,000, with no costs order. Messages and valuation evidence were material. The judgment does not establish actual payment of that award.
A goods return lawyer needs to see why possession was initially transferred and what happened after repayment. State whether the item was security, stored temporarily or allegedly sold. A dispute about its purpose may remain even when nobody disputes that the other person physically received it.
Identify the item and ownership evidence
Provide receipts, photographs, serial numbers and any registration or warranty record. Explain how you acquired the property and whether another person has an ownership interest. For an engine or business tool, identify the specific item rather than merely its general description or an estimated replacement price.
Keep records of condition and use before it was handed over. If a replacement was proposed, identify that replacement and the reasons it was accepted or rejected. A different machine should not be treated as the original without checking its identity, condition and the terms of the proposed substitution.
Reconcile the loan and payment record
Supply the loan agreement or messages recording the amount and repayment arrangement. Prepare a dated ledger of amounts advanced and repaid. Attach complete transfer records, including payments made through another platform. Mark any amount acknowledged by the lender separately from an amount still disputed.
An advocate needs to distinguish the principal from additional demands. If a person insists on another payment before releasing the item, preserve the exact communication and any agreement said to authorise it. Do not treat a newly demanded sum as an agreed loan term without supporting evidence.
Document the demand for return
Retain written requests for the property and the responses received. Record when repayment was completed and when return was sought. If you made an oral demand, describe the participants and date and provide any available corroboration. Include later messages that acknowledge possession or explain what happened to the item.
Avoid editing screenshots in a way that removes the surrounding conversation. Export the full relevant exchange where possible. An adviser should be able to follow changes in the other person's explanation, while keeping allegations distinct from admitted facts and judicial findings.

Explain whether the original item is believed recoverable or whether compensation is sought because it is missing or damaged. Identify the available information about its present location. If another person allegedly received it, provide the evidence of that transfer and avoid inventing their involvement from rumour.
For a monetary claim, supply a reliable valuation or relevant quotations with dates and specifications. Distinguish purchase price, current value and replacement cost. If business income was lost, keep that claimed loss separate with its own records. Do not assume the value awarded in Warda applies to your property.
Bring earlier complaints and proceedings
If you reported the matter to police or another authority, include the reference and outcome documents. Explain whether a civil case already exists. A prior complaint may help reconstruct events, but it should not be described as proof of civil liability unless the actual record establishes that point.
Provide any demand from the other side and any settlement offer. The adviser needs the full record, including an assertion that the property was sold or forfeited. Those arguments must be assessed against the agreement, repayment evidence and subsequent dealings.
