You made payments to reduce mortgage arrears, but the bank applied part of them to legal fees and an auction is still threatened. A mortgage payment allocation lawyer or advocate in Mombasa should identify the disputed entries and the latest court orders. A new accounting event may need different analysis from merely repeating an earlier unsuccessful injunction application.

What the Mohamed ruling preserved

The High Court stayed the bank's statutory sale and restrained disposal pending the appeal, subject to KSh 50,000 monthly payments. Two consecutive missed payments permitted the bank to apply on notice for discharge; failure to file and serve the appeal record within 30 days also exposed the protection to a discharge application. Costs were reserved to the appeal or cause. The alleged diversion to fees was arguable, not finally adjudged unlawful. The debt was not cancelled and the final appeal remained undecided.

Identify the payment and its allocation

Bring proof of each payment and the corresponding account entries. State what you understood the money would pay and provide the instruction or agreement supporting that understanding. A deposit into a loan account does not necessarily show how the bank allocated it internally.

Request an itemised explanation of the disputed fee debit. Keep its date and amount separate from ordinary instalments, profit or interest and other costs. The advocate needs to assess whether the issue concerns a contractual charge, misallocation, an inaccurate balance or more than one of these.

Compare the facility terms and any variation with the allocation relied upon. Preserve correspondence about restructuring and repayment proposals. A proposal you sent is different from an agreement accepted by the bank, and the evidence should make that distinction clear.

Compare the new event with the earlier application

Supply the first injunction application, the ruling and the subsequent application. Make a timeline identifying which payment or debit occurred before and after the first decision. The lawyer should assess whether the later issue is genuinely new rather than simply a different description of an old argument.

Include the bank's response and any res judicata objection. Do not assume that issuing a fresh sale notice automatically opens every previously determined issue. Explain the specific change in the account or conduct on which the later request relies.

Keep the merits of that objection separate from interim preservation pending appeal. An arguable appeal does not establish that the borrower will win it. The adviser needs to assess both the proposed appeal and the risk requiring temporary protection.

Preserve the current auction record

Bring the sale notice, redemption notice, advertisement and valuation material received. Identify the scheduled date and any indication that the auction occurred. A request aimed at a past date may need a different formulation from protection against future transfer or further sale steps.

Explain the property's current registration and occupation position from available records. Do not assume a scheduled auction was completed, or that no later action occurred because an application was pending. The advocate should investigate the actual stage before selecting the relief.

Provide any order already served on the bank or auctioneer and proof of service. The exact terms matter: temporary restraint, statutory-sale stay and a general description of status quo should not be treated as interchangeable without reading the order.

Make an affordable proposal with supporting records

If payment conditions are proposed, bring income and expenditure records relevant to the offer. State what you can consistently pay and explain the source. A figure intended only to obtain temporary relief can create a difficult compliance position if it does not reflect real ability.

Keep partial payments visible in the reconciled balance. Protection pending appeal may still require ongoing payments, and neither an application nor a stay should be described as a waiver of the facility. Ask the advocate how payments should be recorded and acknowledged under the actual order.

A matrimonial or only home is an important factual circumstance, but should not be presented as automatically immune from enforcement of a charge. Provide the evidence of its use and the wider circumstances supporting the request for preservation.

Track every condition in the protection order

Create a calendar from the court's actual directions, including payments, filing and service. Retain receipts and acknowledgment in one file. A missed condition may expose the order to a further application, whose procedure should be read precisely rather than assumed to cause automatic cancellation.

Provide the current appeal record and any later directions at the consultation. This June ruling alone cannot establish the property's position months later. The lawyer should check subsequent orders before advising that the stay remains in force.

For a Mombasa payment allocation and auction consultation, bring the facility terms, disputed ledger entries, complete application history and current sale documents. A lawyer and advocate can assess the new accounting issue, the proper appeal relief and the compliance obligations attached to any interim protection.
