Decision analysed: Oketch v Oketch — [2026] SCC 124 (KLR) — 4 May 2026

Court: Small Claims Court at Mombasa

The dispute

The claimant sought KES 76,000 as a repayable advance for a music event. The respondent alleged joint-venture funding rather than a loan. M-Pesa records established KES 74,400; vendor vouchers and unsupported event assertions did not establish the joint venture on that record.

What the Court decided

The Mombasa Small Claims Court awarded KES 74,400, interest at court rates from filing and KES 5,000 costs. The larger KES 76,000 demand was not fully proved. The decision applied the Court flexible evidence provisions to the available transactions.

What this decision does and does not establish

Small Claims Court Act sections 3(3)(d) and 32 informed evidential flexibility; this does not create a universal exemption from electronic-evidence requirements in other courts. The claimant must prove the loan and amount, while a joint-venture allegation needs evidence of the agreed arrangement. Do not publish participants telephone numbers or transaction identifiers.

Choose a document for the procedural task

Small Claims Statement of Claim for an M Pesa Music Event Loan

Use the prescribed Small Claims Court statement-of-claim form and rule 3, with genuine documents and lawful service. Check the monetary and territorial jurisdiction, related litigation, limitation, amounts and specific relief. This is substantive wording for the form, not an ordinary civil plaint.

Small Claims Response Alleging a Music Event Joint Venture

Complete the prescribed Small Claims Court response and serve it under rules 9 and 12. Give precise admissions, denials and the evidence for any counterclaim or set-off. Check the current summons and directions; this is substantive wording, not the prescribed form.

Lender Witness Statement on M Pesa Advances and Repayment Terms

Use the witness own truthful account, distinguish observed events from named information sources and identify bundle pages and authenticating witnesses. Follow the actual trial or succession witness directions. Additional evidence and statements require any applicable leave. An appeal ordinarily uses the admitted trial record; a new statement cannot be inserted without the proper procedure.

M Pesa Transfer and Claimed Loan Balance Schedule

This is an evidential or accounting aid, not an originating process or independent proof. Give dates, authors or custodians, admissibility status, actual document pages and transparent calculations. Label missing and disputed items. Obtain the applicable leave or directions for supplementary evidence, serve it and prevent duplicate credits or recovery.

Submissions Distinguishing a Personal Loan from Event Venture Funding

Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding.
