The mortgage has been closed, but you believe the refund left out excessive charges and wrongly calculated interest. A mortgage overpayment reconciliation lawyer or advocate in Nairobi should test the account from disbursement to closure. An accountant's large refund figure can be useful only if its documents, assumptions and method withstand examination; proving errors and proving the full sum demanded remain separate tasks.

What the Achira judgment ordered

The Nairobi commercial case resulted in KSh 500,000 general damages and KSh 113,454.97 admitted repayment, with judgment-date interest and suit costs. The court rejected the larger claimed calculation and ordered fresh accounts by a jointly appointed neutral accountant, with an alternative ICPAK nomination route. The report was due within 45 days of appointment and further orders were reserved. This was not an award of the claimed KSh 6.5 million or a universal prohibition on mortgage charges.

Reconstruct the account from the executed documents

Bring the offer, charge, amendments and full statement history available. Identify when funds were actually advanced and where the money went. The calculation should not assume that an application date or document date was the disbursement date without supporting evidence.

Mark the provisions concerning interest, calculation periods and variation. Explain any difference between the offer and charge wording. The advocate and accountant need the complete contractual arrangement, not a single rate extracted from a letter while ignoring a relevant condition or amendment.

Record repayments in chronological order with bank evidence. Explain adjustments and reversals instead of treating every debit as principal or every credit as a cash refund. A coherent ledger helps isolate the error alleged rather than relying on a final balance alone.

Check the authority and timing of interest changes

Collect variation notices and available proof of delivery. Compare the notice date, effective date and actual rate applied in the statements. Do not assume the contract's notice requirement was satisfied simply because the bank produced a letter about the new rate.

Keep rate variation separate from the frequency of calculation or capitalisation. These can affect the account differently. Ask the accountant to explain the adopted method, the contractual provision supporting it and the entries affected by each disputed assumption.

A rate used in this historical mortgage should not be imported into a modern facility. The adviser should assess your executed terms and the law relevant to the period concerned. The case provides an example of examining the account, not a standard rate for all borrowers.

Classify fees and insurance premiums properly

List legal, valuation, auctioneer and insurance entries separately. Provide the invoice, receipt or explanation available for each. The question may concern contractual authority, actual expenditure, the connection to the security or whether any recoverable balance existed when enforcement costs arose.

Distinguish property insurance from protection tied to the outstanding mortgage. Record the cover period and basis for the premium rather than assume all insurance charges depend on the same variable. Ask for the relevant schedule and evidence identifying the risk insured.

Where the account was closed or recalculated, identify later debits clearly. Supply the bank's explanation and your objection. A charge after closure needs investigation, but its date alone should not be substituted for a complete analysis of what it represents.

Treat refunds and admissions as specific evidence

Bring reconciliation letters, refund records, write-offs and discharge documents. A write-off of a claimed debt and payment back to the borrower are different accounting events. Show each separately so that money not actually paid is not described as a completed refund.

Identify the precise amount admitted by the bank and what remained disputed. An acknowledgment of an error does not necessarily admit every figure in the borrower's report. The advocate needs to compare the admission with the larger claim and its evidence.

Preserve the wording and status of settlement correspondence. Ask for advice on its use and implications rather than assuming all negotiations stop time running or every letter restarts it. Current limitation advice must be based on the actual dates, wording and procedural history.

Make the expert calculation independently testable

Ask the accountant to identify the source records, missing periods and assumptions. Provide the bank's available records and objections, not only your own selected statements. A neutral exercise should explain competing calculations and why one is preferred.

Keep supporting schedules with the report. The advocate should be able to trace a claimed overpayment to particular entries and rules of calculation. A conclusory figure without a reproducible method is harder to assess in negotiation or proceedings.

For a Nairobi closed mortgage consultation, bring the executed facility documents, account history, notices, charges and earlier refunds. A lawyer and advocate can assess the scope of the accounting dispute and the remedy required. If the court has already directed neutral accounts, provide that order and track appointment, reporting and later directions separately from the amounts already awarded.
