If you need a disputed payment refund lawyer at Milimani Small Claims Court, Nairobi, an advocate should review your documents and any deadline. This article analyses Mutiso v Mutuku, explains the court’s decision and identifies practical records to prepare for a review of your situation.

A Nairobi disputed payment refund lawyer or advocate should distinguish proof that money changed hands from proof of the transaction's alleged purpose. In Mutiso, the claimant did not establish the pleaded car sale, but the Milimani Small Claims Court found a recoverable balance on the payment records. The claim succeeded partly. It was not a finding that the asserted vehicle agreement had been proved in full.

The documents supported a narrower recovery

The claimant described a failed car purchase; the respondent relied on computer equipment dealings. The court found Ksh 351,000 in documented payments and Ksh 90,000 repaid. The alleged additional cash payment was not established, and the respondent did not prove delivery or a lawful basis for retaining the remaining money.

The award was Ksh 261,000 with court-rate interest from judgment and Ksh 25,000 costs. A thirty-day stay of execution was granted. The police-station acknowledgement did not establish the alleged car sale by itself. Actual later payment, delivery or enforcement is outside the judgment reviewed here.

Identify each transaction rather than one combined story

For an advocate enquiry, list each transfer, invoice, order and delivery alleged. Where the parties had several dealings, explain which payment relates to which transaction and why. A narrative that all funds concerned a vehicle can be difficult to assess if the contemporaneous records describe other goods.

Keep the documents in their original sequence. Include messages that support or contradict the asserted purpose so that the adviser sees the full history. An advocate can then compare the pleaded transaction with the records instead of relying on a later label attached to otherwise unexplained transfers.

Separate documented transfers from cash allegations

Provide complete bank or mobile money records with dates, amounts and recipients. For each asserted cash payment, identify the receipt, acknowledgement or available witness material. Mark an unsupported assertion as such rather than adding it to the proven balance without explanation.

The Mutiso court did not accept the additional cash component merely because other payments were documented. A current review should maintain that distinction. If a record is missing, explain what is unavailable and any attempt to obtain it, without reconstructing an exact figure or date from uncertain recollection.

Match invoices with the alleged goods

Collect invoices, delivery notes, acceptance records and complaints. Identify whether goods were supplied, returned or never delivered. A respondent asserting supply should provide the material supporting delivery, while a claimant seeking a refund should explain what was expected and what actually occurred.

The court treated the computer invoices as a plausible explanation for the payment pattern but still found the retained balance recoverable. Those are distinct conclusions. A useful enquiry should not assume that an invoice alone proves complete performance or that uncertainty about the transaction automatically defeats every claim for return of money.

Preserve the repayment agreement and its context

Supply the full agreement, later payments and correspondence concerning settlement. If execution or voluntariness is disputed, explain the circumstances and supporting record. Keep that dispute separate from the account reconciliation, which may establish a balance even where the parties disagree about the original transaction.

An advocate needs the acknowledgement's wording and the existing evidence rather than a statement that the police settled the case. The Mutiso judgment did not establish the claimed vehicle purchase through the acknowledgement alone. It also did not make a criminal finding arising from the parties' complaints.

Track what was actually filed

Where leave to submit more evidence was granted, provide the order and documents ultimately filed. Permission to add material is not proof that it entered the record. The court noted that the claimant did not use the opportunity for additional papers and submissions in this proceeding.

For a current enquiry, include the judgment, decree and later payments or directions. Mutiso illustrates a partial refund award based on proven transfers and a retained balance, despite failure to prove the pleaded car-sale narrative. A Nairobi advocate should review payment, purpose, performance and procedural records as connected but distinct questions.
