If you need a family land trust and acquisition compensation lawyer or advocate for a matter connected to Milimani Environment and Land Court, Nairobi, start with the actual orders and documents. This article analyses Gatuma v Mbai & 2 others, decided by Milimani Environment and Land Court.

A family title and compensation dispute

Gatuma concerned five family properties registered in an elder brother's name and money generated by compulsory acquisition of part of Dagoretti/Uthiru/281. The Nairobi Environment and Land Court found a customary trust established. It declared the properties and acquisition money part of Gatuma Kungu's estate, left distribution to the succession court and restrained the National Land Commission from releasing the money except under court orders. Each party bore its own costs.

The judgment did not allocate equal shares to ten beneficiaries, although equal sharing had been requested. Establishing that assets belong to an estate and deciding who receives them are different questions. Its heading identifies Nairobi ELC; the judge signed and delivered it virtually from Kajiado. This is not a Dagoretti Law Courts judgment.

Identify the family asset before discussing shares

A family land trust lawyer needs the registered title, historical register and documents explaining how the named owner became registered. A family description of the land as ancestral may be relevant but does not replace evidence. Prepare a parcel history showing old numbers, subdivisions and the present registered owner. Distinguish a document obtained from the registry from an unverified copy supplied by a relative.

Record which family members occupied each property and when. If you rely on the proposition that a relative held land for others, explain the acts and statements supporting it. Keep records of family meetings, earlier proceedings and arrangements concerning use or burial. An advocate needs the specific circumstances surrounding registration, rather than a conclusion that every title in an elder sibling's name must be a trust.

Keep ownership and succession records together

Provide any succession cause number, grant, confirmation order and later directions affecting the same assets. Explain whether the registered owner, the person said to have created the trust or both have died. Identify the representatives named in existing proceedings and provide the documents showing their authority. Do not assume that every family member can act for a deceased person's estate in the same way.

Gatuma shows why the requested result must be precise. A declaration about estate ownership can leave distribution for a different proceeding. For consultation, write down whether you want recognition of a trust, prevention of disposal, clarification of estate assets or distribution among beneficiaries. The advocate can compare that objective with the court orders already made and the issues still open.

Track the acquisition money separately

Where part of the land was acquired, supply acquisition notices, valuation correspondence, award documents and any communication about payment. Identify the parcel affected and the payee named. Keep a land ownership timeline separate from a payment timeline: the dispute may concern entitlement to compensation even after physical acquisition has occurred.

Mark sums as proposed, awarded, paid or still disputed. Preserve evidence of any release already made and identify the account or recipient only in the private consultation documents. A published judgment restraining release does not prove that the money was subsequently recovered or shared. Obtain the latest correspondence and any later order before describing the current payment position.

Explain the immediate risk

If compensation may be released soon, supply the actual notice or communication suggesting that risk. If disposal of a family parcel is your concern, attach the search and the transaction documents available to you. Separate what you witnessed from what someone told you. A focused chronology helps an advocate decide which facts require further confirmation.

For independent lawyer and advocate review at Milimani Environment and Land Court, send the title history, family evidence, succession records and compensation papers. State the immediate concern and any recorded court date. The case illustrates proof of a particular customary trust and separation of estate ownership from distribution; it does not establish a universal entitlement for relatives or guarantee the outcome of a new claim.
