An advocate confirms availability, scope and fees before accepting your matter. You have a decree and want the insurer to satisfy it, but the insurer produces an earlier settlement for the same accident. An accident compensation payment dispute lawyer or advocate in Nairobi needs the complete history of claims and payments. The current decree cannot be assessed safely in isolation from an earlier judgment, discharge or payment through a representative.
What the Wanjohi appeal decided
The High Court allowed the insurer's appeal and dismissed the declaratory enforcement suit. It found that the earlier KSh 572,000 compensation had been paid and that the later claim raised res judicata and duplicate compensation concerns. The insurer received appeal costs. The court did not order a second payment under the later decree. This result depended on the same accident and earlier recovery established in the record, not on a general rule that any unrelated payment defeats an injury claim.
Assemble every file connected with the accident
Bring the pleadings, judgments and decrees from each claim, not just the most recent decree. Identify the claimant, defendants, accident and injury alleged in each. Different file numbers do not by themselves establish that the claims concern different losses or events.
Prepare a chronology showing when each claim was filed, decided and paid. Include any appeal or later order affecting it. The advocate should be able to compare the disputes without relying on an informal description that one was a small claim and the other a civil suit.
Explain any legitimate difference between claims with the documents supporting it. If separate people or distinct losses are involved, identify them precisely. Avoid treating a change of representative or procedural route as proof that a second recovery is permissible.
Trace payment through the actual recipient
Obtain the insurer's payment record, cheque or bank transfer evidence and any discharge. Record to whom payment was made and on whose behalf. Payment to a representative raises an accounting question that should be investigated accurately rather than ignored because the client did not receive cash directly from the insurer.
Provide the representative's client account statement or correspondence explaining the payment and deductions. Distinguish the insurer's discharge of an obligation from an unresolved question about distribution of the proceeds. They may require different evidence and potentially different remedies.
If you dispute that a cheque cleared, supply the available bank record or request clarification through the adviser. An issued cheque, an acknowledged payment and completed clearance should be distinguished. The aim is to establish what occurred, not select the document whose wording is most convenient.
Read the settlement wording carefully
Keep the complete discharge voucher and any cover letter. Identify whether it concerns a particular decree, part payment or final settlement. A signature may raise questions of authority or scope that need examination; it should not be described as meaningless or conclusive without assessing the record.
Disclose any reservation of rights or objection made at the time. Later dissatisfaction may differ from a contemporaneous dispute over the terms. The lawyer needs to see how the settlement was offered, accepted and implemented before advising on a further demand.
Record the net amount received and any outstanding account from the representative. Do not automatically add those deductions to a second claim against the insurer. Ask the advocate to identify the legal basis and proper participant for each disputed amount.

List the heads of compensation in each judgment and the payment attributed to them. Interest and costs should be recorded separately from injury damages. A larger later decree does not explain why the earlier disposition would cease to matter.
Provide medical and other loss records if a genuinely distinct claim is alleged. Explain when the loss arose and how it relates to the earlier proceedings. The adviser must assess finality and the scope of prior findings before deciding whether further litigation is available.
Avoid presenting a payment shortfall as permission to restart the whole accident claim. An enforcement or accounting step may be more relevant than another merits suit, depending on the existing orders. The correct route follows the record and remedy required.
Respond to the insurer's objection with a complete account
Give the advocate the objection, supporting affidavit and exhibits. Identify any factual error in the insurer's history with a specific record. General insistence that the later decree exists will not address evidence of an earlier paid claim concerning the same loss.
If proceedings are already underway, disclose all prior recoveries in the advice process. Prepare an accurate reconciliation before settlement discussions. Omissions can complicate a legitimate dispute and make it harder to distinguish an unpaid item from an attempt at double recovery.
For a Nairobi insurance payment consultation, bring all accident claims, decrees, settlement documents and payment records. A lawyer and advocate can assess what was discharged, what remains genuinely unpaid and whether the issue is enforcement, finality or accounting for funds already received. This judgment makes the payment history central to that assessment.
