An advocate confirms availability, scope and fees before accepting your matter. The insurer has rejected your damaged-car claim as fraudulent. Yet one assessor agreed with the account of the accident and another report reached the opposite conclusion. An insurance fraud rejection lawyer or advocate in Nairobi needs the complete sequence of reports. The important question is what evidence supports the allegation, especially if an assessor changed position after inspecting the same vehicle.
What happened in Monarch's appeal
In Monarch Insurance v Insurance Regulatory Authority, the Nairobi High Court dismissed an insurer's appeal after examining conflicting assessment reports. It found the fraud allegation unproved and upheld the Insurance Appeals Tribunal's decision affirming a direction to settle the claim. The interim stay lapsed, and appeal costs went to the respondents. The court could examine whether an evidential error amounted to a question of law, but found no basis to overturn the Tribunal. The judgment does not make a police abstract conclusive proof of cover or require payment of every disputed motor claim.
Get the precise reason for rejection
Ask for the written repudiation and identify the policy clause relied upon. Fraud, non-disclosure, an exclusion and a disagreement about repair cost are different issues. A letter using several labels may require the advocate to clarify which allegation the insurer actually maintains. The response should address that allegation rather than merely restate that the vehicle was insured.
Keep the schedule, full policy wording, endorsements, claim form and statements supplied during the investigation. Give the adviser the version in force at the relevant time. A renewal or later policy may look similar while containing different terms. List any information corrected after the claim so that discrepancies can be explained accurately.
Do not improve the accident account after seeing an assessor's conclusions. If an earlier statement contains an error, identify it and explain when it was discovered. A lawyer can help present a truthful correction. Rewriting the account to fit physical findings can create a more serious evidential problem than the original uncertainty.
Compare reports by their underlying material
Arrange every assessment in date order, including draft or revised versions where available. For each, note the inspection date, photographs used, measurements, documents reviewed and conclusion. An advocate needs to see whether a changed conclusion followed new evidence or simply a reconsideration of the same material.
Preserve correspondence commissioning inspections and asking follow-up questions. A report may have addressed repair value while another addressed accident mechanics. Different conclusions are not necessarily contradictory if the experts answered different questions. State the question before comparing the answer.
Where impact geometry, vehicle height or paint transfer is disputed, retain original photographs and inspection records. A selected close-up without context can be misleading. Keep the wider scene, vehicle position and date information when available. Explain which images were taken by you and which came from investigators or repairers.
The adviser may recommend an independent technical opinion. The expert should receive the adverse material as well as documents supporting the claim. An opinion based on an incomplete bundle may not resolve the insurer's concern and can incur expense without helping the case.

Proof that an accident occurred is not the same as proof of every claimed loss. Keep the ownership record, insured interest, valuation, repair estimate and salvage correspondence. Identify any excess or other contractual adjustment shown in the policy. Explain whether the claim concerns repairs, total loss or another specified benefit.
If another person drove the vehicle, include the relevant driver documents and account. Do not assume the registered owner personally witnessed the accident. An advocate needs to know who can explain the event and what documentary support exists for that account.
A police abstract can be important evidence, but the consultation should not stop there. Preserve investigation correspondence, scene records and available witness details. The lawyer can assess how those documents interact with the policy and the insurer's specific objection, rather than treating one document as a universal answer.
Match the next step to the decision already made
If the matter has been before the regulator or Insurance Appeals Tribunal, provide the complete decision, not just the paragraph favourable to you. Include the appeal notice, any stay order and subsequent directions. A court challenge may involve limits on the questions that can be raised; it is not automatically a fresh investigation of the entire accident.
Tell the advocate whether you are responding to an insurer's appeal, considering your own appeal or seeking implementation of an existing decision. Those are separate tasks. A stay granted while an appeal is pending should not be mistaken for a finding that the fraud allegation was proved.
The Monarch reproduction describes a former commercial appeal subsequently designated as a civil appeal. Verify the current registry record when preparing documents. This article links the Nairobi High Court civil context and does not attribute the High Court judgment to a magistrate merely because its venue is described as Milimani Commercial Courts.
For a Nairobi insurance fraud rejection consultation, send the repudiation letter, operative policy, all assessment versions and any regulator or Tribunal orders. A lawyer and advocate can then assess the alleged fraud, the quality of the evidence and the procedural step required to pursue the claim.
