An advocate confirms availability, scope and fees before accepting your matter. You paid for an international flight but were offloaded at JKIA after a dispute at check-in. A replacement route cost more, and you want to know what can be recovered. A passenger offloading lawyer or advocate in Nairobi should examine the reason given, the evidence of the incident and the expenses caused by the missed journey. Establishing a contractual breach does not settle every requested category of compensation.
What the Haase appeal decided
The High Court dismissed both the passenger's appeal and the airlines' cross-appeal, leaving the aviation tribunal's judgment intact. The finding of contractual breach and the special damages award remained; additional general and punitive damages were refused. Each side bore its appeal costs. This was an appeal from the National Civil Aviation Administrative Review Tribunal, not from the Small Claims Court. The security explanation had not been satisfactorily supported by the evidence in that case.
Write down the incident while it is clear
Record the check-in time, flight details and sequence of events. Distinguish what you personally heard from what another traveller later told you. The advocate needs an account that can be compared with the airline's explanation, including any instruction you were given and how you responded.
Preserve written reasons for refusal of carriage, messages and complaint acknowledgments. If the reason changed between the airport and a later response, keep both versions. An adviser should be able to see the original wording rather than a summary that merges different explanations.
Identify witnesses and any airport report. Note who observed the relevant interaction and who only arrived afterwards. Provide their contact details privately to the lawyer. Do not assume that the existence of CCTV means you already have access to footage or that it will remain available indefinitely.
Identify the carrier and relevant terms
Bring the ticket, booking confirmation and itinerary. An airline whose name appears on the booking may differ from the operating carrier. Where companies share an itinerary or service arrangement, your advocate should establish each role and assess which party is connected to the disputed decision.
Supply the conditions of carriage provided for your journey and correspondence about them. Do not rely solely on a current website version if the flight occurred earlier. The adviser should review the terms applicable to the incident and the reason actually relied on for offloading.
Tell the lawyer whether the problem involved security, documentation, lateness, overbooking or another issue. These are not interchangeable situations. A decision concerning an unsupported security defence should not be presented as a rule requiring an airline to carry every passenger regardless of the circumstances.

Keep the unused ticket details and any refund received or requested. Identify the particular segment you could not use. A return booking may include a leg already flown, so the whole ticket price and the value of the missed segment need separate consideration.
Collect replacement tickets, taxi receipts and other actual expenditure. Match each expense to the disrupted journey and explain why it was incurred. A later trip chosen for unrelated reasons should not be included without explaining the connection to the original refusal.
Create a dated calculation that preserves the currency of each payment. Record any exchange evidence used in converting amounts. Keep reimbursements and insurance payments visible so the proposed claim does not accidentally seek the same financial loss twice.
Discuss compensation without assuming an automatic amount
Tell the advocate about consequences beyond the receipts, but distinguish evidence from estimates. A missed engagement or loss of income requires supporting records and a clear explanation of the connection. A large round figure cannot substitute for that account.
If you seek compensation for injury or another personal consequence, provide the relevant records privately and ask which legal basis applies. An unpleasant encounter and a compensable injury raise different questions. The advice should reflect the actual evidence and applicable carriage rules.
Keep a request for repayment of proved expenditure separate from a request for general or punitive damages. A lawyer should explain the prospects and evidential needs of each. The Haase outcome illustrates why a successful liability finding can coexist with refusal of additional categories of damages.
Before a consultation, organise the ticket, incident chronology, airline response and expense schedule. A Nairobi advocate can assess the correct parties and forum, the contractual explanation for refusal and the particular losses that a claim or appeal can reasonably support.
