Money has been withdrawn from your M-Pesa wallet at agents while you say you were incapacitated and could not authorise it. A mobile-money withdrawal lawyer or advocate in Nairobi should examine the transaction records and the applicable agent verification terms. Correct credentials and actual authority are questions that need careful evidence, not assumptions in either direction.

What the Wanjiru judgment awarded

The High Court reversed dismissal of the claim and awarded KSh 462,445 special damages and KSh 150,000 general damages jointly and severally against the two respondents, with filing-date court interest and both courts' costs. It relied on incapacity evidence, the June 2022 logbook term and failures in the respondents' evidential response. This case-specific result does not establish automatic liability for every stolen-phone withdrawal or confirm today's customer terms.

Preserve a precise transaction sequence

Request official statements and identify the disputed withdrawals by time, amount and agent reference. Separate transfers into the wallet from withdrawals out of it. The institution responsible for one stage may not be the same as the party whose conduct is challenged at another.

Record when the phone was lost, when you discovered the transactions and when you reported them. Keep complaint references and responses. Explain any interval you cannot reconstruct. A clear sequence allows your adviser to connect the financial records with the evidence of your condition.

List reversals, refunds and other recovery already received. The claim should reflect the remaining loss and avoid counting the same amount twice. If an investigation is ongoing, distinguish confirmed information from what you have been told informally.

Support the account of incapacity

Provide relevant police, medical and witness records through a confidential channel. Identify who observed you and when. Evidence of your condition at the withdrawal times can be central; an account of an incident occurring earlier may leave a gap that needs explanation.

Ask witnesses to provide their own account without coaching them to match a legal conclusion. Preserve contact details privately for the adviser. A person who found you or assisted you may have information different from a person who only heard about the incident later.

Do not publish sensitive medical or identification details in an initial web enquiry. Explain the issue briefly and tell the advocate that supporting documents are available. The substantive review can then proceed with an appropriate arrangement for confidential material.

Obtain the terms that applied on the transaction date

Keep the version of customer terms relied on, including evidence of its date and source. Do not substitute the latest online wording without checking changes. A case discussing older terms should not be treated as proof that the same manual verification requirement applies unchanged to a later transaction.

Identify the particular safeguard said to have been breached. Your claim may concern agent procedure, account access or another issue. Distinguish them so the adviser can identify the necessary records and the correct parties rather than asserting a general system failure without support.

Preserve any notice of a change to terms or procedure. If the provider says electronic verification replaced another step, ask for the underlying documentary basis through the appropriate process. The legal effect requires review of the actual contract and evidence.

Examine the investigation response

Keep the full response and report, not only a screenshot of the conclusion. Identify the author, date and supporting records where disclosed. A statement that valid credentials were used should be examined for what it establishes and what remains unanswered.

List records you requested, including agent records and logs, and the responses received. Your advocate can assess how relevant information may be obtained and which evidential questions arise. Do not assume that a missing document alone proves the whole claim or eliminates your initial proof obligations.

Avoid contacting suspected offenders or trying to access another person's account. Coordinate the civil recovery issue with any police investigation. A criminal complaint and a civil claim have different purposes and should be described accurately in both records.

Assess relief and the court stage

Prepare a calculation of the disputed loss, supported by statements. Describe any additional harm separately and identify supporting evidence. The damages in a reported case are not a tariff for your claim, and each requested remedy needs a proper basis.

If the Small Claims Court has already decided the matter, supply its record and identify the legal issue for appeal review. A Nairobi advocate can then assess the applicable terms, the evidence of incapacity and authorisation, the response from record holders and the realistic route to recovery.
