A claim reached the company's email inbox. Someone filed an appearance, but no response followed. Months later, the business discovers a default judgment. A Small Claims email service lawyer or advocate in Nairobi needs to inspect the whole sequence. The argument that email was the wrong mode of service may be affected by what the company did after receiving the documents.

The Boma Hotel decision

The High Court dismissed Boma Hotel's appeal from a refusal to set aside a Milimani Small Claims default judgment. It explained that email service without court directions can be vulnerable under that court's particular procedural regime, but the company had filed an appearance and acquiesced in the service. It also failed to annex a draft defence demonstrating triable issues. The appeal failed with costs. This was not blanket approval of email service in every Small Claims case, nor a merits determination that separate branch invoices can always be split between courts.

Retrieve the court record before drafting a response

Obtain the statement of claim, service certificate, attachments, mention notices, appearance and judgment. Preserve the emails as received, including the sender, recipients, date and attachments. A screenshot of an inbox subject line may omit the document actually served. The advocate needs to compare the transmission with the court record.

Identify who controlled the address and who acted on the message. Was it a published company address, a staff member's personal account or an address no longer used? Record the factual position without assuming that internal forwarding or failure to forward settles the legal question. The service dispute concerns the applicable procedure as well as what happened inside the business.

Check whether the adjudicator authorised an alternative mode of service. A claimant saying that email is convenient is different from a court directing its use. Include the actual order and any directions about response time. The adviser can then assess service against the regime applicable to this court, rather than import assumptions from an unrelated civil proceeding.

Explain every step after the documents arrived

Make a short chronology of receiving the claim, consulting anyone, filing an appearance and learning of judgment. Attach the documents supporting each event. An advocate cannot safely argue that the business never participated if the record contains its appearance. Describe any dispute about authority separately and provide the evidence behind it.

An appearance and a response are different documents. Ask what was actually filed and accepted, not what a member of staff intended to submit. A message to the claimant proposing payment may also differ from a response filed with the court. Keep copies of both so their purpose is clear.

Explain delay with dates and records. If a person handling the matter left employment, identify when and how responsibility changed. If documents went to the wrong department, show the routing rather than giving a general description of an administrative mistake. A precise explanation allows the lawyer to assess its relevance without promising that the court will accept it.

Show the defence you want the court to hear

Saying there is a genuine dispute is a starting point, not the complete proposed defence. Identify which invoice, supply, payment or contractual obligation is disputed and why. Give the advocate delivery records, correspondence and the ledger supporting that position. The proposed response should address the claim actually pleaded.

Where payment is the defence, identify the invoice allocated to each remittance. A payment on another account may not discharge this claim. If an earlier settlement is relied upon, provide its signed terms and scope. The adviser needs to distinguish an agreement covering all outstanding accounts from one covering a specified debt.

If you believe the claimant divided one transaction into multiple suits, provide both pleadings and the underlying contracts. The Boma appeal recorded such an argument, but its operative reasoning does not justify a general conclusion allowing artificial division. Forum and claim-identity questions need their own supported assessment.

Check execution and any request for protection

Send any demand under the decree, auctioneer correspondence and current stay order to the lawyer immediately. An application seeking to reopen judgment should not be treated as proof that execution has stopped. Ask the advocate to establish the current position from the file and any operative directions.

Keep the judgment sum, payments and amounts sought for costs on separate lines. This helps identify whether the urgent concern is the underlying claim, the remaining balance or an enforcement step. Avoid promising payment terms that the business has not approved simply to gain more time.

For a Nairobi Small Claims default judgment consultation, supply the email and service record, every filed document, the judgment and the proposed defence evidence. A lawyer and advocate can assess participation, service, delay and the actual disputed debt together, rather than rely on one procedural objection in isolation.
