An advocate confirms availability, scope and fees before accepting your matter. The interview is still online, and you are worried that another clip will spread tomorrow. What can an urgent application actually achieve? A social media defamation injunction lawyer or advocate in Nairobi should distinguish an order preventing further publication from an order requiring existing material to be removed. They require separate consideration, even when the complaint concerns the same recording.
What the Ciuri ruling decided
The Nairobi High Court partly allowed an interim application concerning an interview. It restrained repetition of the impugned utterances pending trial but declined mandatory removal of existing material. The pleaded truth and fair comment defences still required examination at trial, and the exceptional basis for an interim mandatory injunction was not established. The applicant received application costs. This was an interim ruling, not a final liability judgment or damages award. The court did not order the platforms to delete the recording.
Preserve the publication before asking anyone to remove it
Give the advocate the exact link and a dated copy of the content. For a video, identify the relevant timestamps and retain the surrounding discussion. A short extracted clip can change the apparent meaning of an interview. Provide both the passage complained of and enough context for the adviser to assess what a reader or viewer would understand.
Record who published each version. The speaker, interviewer, account owner and someone forwarding a clip may have different roles. Make a table of the original upload and subsequent publications you can actually establish. Avoid attributing every repost to the original defendant without evidence connecting that person to it.
Preserve the visible publication date, account name and available audience information. If the account changes its handle, retain the earlier record. Do not describe an estimated audience as a verified number of viewers. A careful record supports a focused application and leaves fewer factual gaps for the opposing party to challenge.
Identify the words and the person they concern
Write down the particular statement said to damage your reputation. Explain how the publication identifies you if it does not use your full name. Provide the features connecting the statement to you, such as a role, photograph or identifiable event. The lawyer needs to assess identification rather than assume that your recognition of the story proves every viewer recognised you.
Separate factual assertions from opinions and the context in which each appears. Bring the documents relevant to the disputed event, including material that may support the other person's explanation. An urgent consultation is more useful when the advocate can test foreseeable defences before presenting the application.
Distinguish the claim that the statement is false from evidence of its impact. A cancelled engagement, an actual enquiry from a customer or a documented professional consequence may illuminate harm. Preserve the underlying message and date. General anxiety about reputational damage should not be converted into invented lost clients or income.

Describe whether the concern is a scheduled repeat broadcast, another upload, circulation of the same passage or continued availability of an existing recording. Those are different proposed restraints. Ask the advocate to connect the requested order to the act that needs to be addressed and to the defendant who can perform or avoid that act.
A request for deletion needs particular attention to what must be removed and by whom. The publisher may control an original upload while having no practical control over a stranger's copy. Supply the account and platform details so the proposed terms do not demand an undefined removal from the whole internet.
Keep an interim request separate from the remedies sought after a full hearing. A court may make a narrower temporary order while leaving liability and compensation unresolved. Explain your immediate objective clearly, without presenting a temporary restraint as proof that you have already won the underlying defamation claim.
Keep correspondence accurate and proportionate
Give the lawyer copies of any demand, reply and platform complaint. Preserve the complete conversation, not only the paragraph that supports your position. Identify any correction, apology or undertaking already offered. The response may affect which publication remains disputed and what further relief is practically needed.
Avoid publishing a fresh allegation about the other person while seeking restraint against them. Discuss proposed public responses with the advocate and keep evidence of any continued publication after an order. If you allege breach, compare the exact later content with the terms of the actual order, rather than treating every mention of you as prohibited.
Check who must receive an order and how its terms are communicated. Keep the court-issued document, service record and any later directions together. A platform reporting tool and a court enforcement process are different steps; neither should be described as guaranteeing the other's result.
For a Nairobi social media injunction consultation, bring the original publication, the relevant passages, the identification evidence, correspondence and the immediate risk you want addressed. A lawyer and advocate can assess whether a focused interim application is supportable and which questions must await trial.
