A judicial administrative officer challenged dismissal following procurement-related disciplinary allegations. The ELRC ordered reinstatement, but the Court of Appeal reversed that outcome. His Supreme Court appeal concerned the disciplinary process, disclosure and constitutional fairness.
The Supreme Court allowed the appeal, ordered reinstatement if the post remained available or equivalent re-engagement, and payment of withheld salary from interdiction. It rejected the bias ground and a new notice-period argument not pleaded below. Additional compensation was declined in the circumstances.
What a fair hearing argument needs
A dismissal appeal should identify the adverse material, the request to see it and the opportunity actually provided to answer it. Attendance at a committee hearing does not by itself answer whether decisive reports were disclosed. The source judgment distinguishes the hearing defect from other arguments which failed: earlier procurement involvement did not establish the bias alleged, and a notice-period point could not be added for the first time through appellate submissions.

Keep the original constitutional pleadings, committee minutes, correspondence about disclosure and the dismissal decision together. Map each appeal ground to an existing record page. An affidavit from a records officer should state what was actually supplied, not infer service from possession of a document. A new report or current staffing document is not automatically admitted just because it is attached to an appellate response.
Frame the employment remedy precisely
Separate reinstatement, equivalent re-engagement, withheld remuneration and any additional compensation. The source outcome restored employment or its equivalent and addressed salary consequences; additional compensation was declined on that combination of relief. A new matter needs its own evidential basis and should avoid claiming the same loss twice. The appeal route also requires the constitutional question to have arisen and been decided below.
