If you need a supreme court review lawyer at Supreme Court of Kenya, Nairobi, an advocate should review your documents and any deadline. This article analyses Amasava v Kenya Revenue Authority & another, explains the court’s decision and identifies practical records to prepare for a review of your situation.

A Nairobi Supreme Court review lawyer or advocate should identify the particular exceptional ground relied upon before asking the court to reopen its own ruling. In Amasava, recovered messages and an affidavit concerning earlier instructions did not persuade the court to revisit its refusal of additional time. The review motion was dismissed with costs to the first respondent. The underlying dispute was not determined anew.

What the court actually decided

The applicant said correspondence previously inaccessible on a damaged phone demonstrated diligence. He also disputed service of opposing documents. The court found none of the exceptional review circumstances established and rejected the suggestion that the previous result depended on the disputed material. It regarded the new correspondence as an attempt to repair an earlier deficient application.

The ruling also addressed the applicant's earlier late notice filed without permission. The June disposition did not grant additional time, admit that notice or establish misconduct by the former advocate. Its operative order dismissed the February motion filed in March; costs were awarded to the respondent that opposed it.

Identify the decision proposed for review

Start an enquiry with the full ruling, the application that produced it and its supporting documents. State which specific conclusion is challenged and why. A general feeling that important evidence was overlooked gives an advocate less information than a reference to the relevant page and the material actually filed.

Keep the underlying appeal separate from the review request. A person may still disagree with the original dispute's outcome, but the reviewing advocate first needs to understand the procedural decision now targeted. Include any subsequent orders so that the enquiry describes the current position as well as the earlier refusal.

Preserve the original correspondence

Where messages are relevant, retain the original records and explain when they became accessible. Prepare a dated account of the instructions, requests for action and responses. Avoid editing a conversation into a version that removes material context or presents an unanswered message as a confirmed agreement.

If a device or recovery process explains the earlier absence of evidence, identify the available supporting record. The Amasava ruling did not treat recovered correspondence as sufficient to reopen the matter. An advocate should assess the actual proposed ground and the evidence's procedural significance rather than assuming that later availability determines the result.

Document service disputes precisely

Collect email headers, attachments, delivery records and any filed affidavit of service. Identify the specific document alleged not to have been received and the date it became known. Keep a party's contention separate from the court's assessment; the fact that service was disputed does not establish that the ruling was obtained improperly.

Provide the previous submissions and ruling together. This permits an advocate to compare what was argued with what the court relied upon. Avoid asserting that one missing document alone caused the outcome without examining the judge's reasons and the applicant's own explanation for delay.

Separate factual corrections from substantive reopening

List any clerical issue separately from the request to change the result. A mistaken date, a disputed evidentiary conclusion and dissatisfaction with discretionary relief raise different questions. The advocate needs a clear description of the proposed correction or order, supported by the relevant material.

The article does not suggest that labelling a disagreement an error guarantees review. A useful enquiry identifies the actual asserted defect and acknowledges the previous procedural history. Supply earlier applications even where their outcome was unfavourable, since omitting them can make an assessment of the present request incomplete.

Prepare for costs and the live procedural position

Include the costs order and any later assessment or demand. The June ruling awarded costs to the first respondent, but it did not state a quantified sum payable in this analysis. Do not substitute a requested amount or private fee for a later assessed inter-party liability.

Amasava illustrates the importance of distinguishing newly produced correspondence from an established ground to reopen a Supreme Court ruling. For a current Nairobi advocate enquiry, provide the challenged order, complete instruction history, service evidence and later directions, with a concise explanation of the specific assistance sought.
