An advocate confirms availability, scope and fees before accepting your matter.Your trip cannot proceed after a transit visa refusal, and the travel agent offers only part of the money back. The deductions are described as airline penalties and processing fees, but you have not seen proof of them. A travel agent refund lawyer or advocate in Nairobi should separate the reason travel failed from the evidence supporting each deduction. A reservation and a payment to an airline are different records.
What the Skyblue appeal decided
The High Court upheld a full KSh 680,425 refund ordered by the Milimani Small Claims Court and dismissed the agent's appeal with costs. Reservation documents did not establish payment to the airlines or the claimed penalties. The court accepted jurisdiction over this contractual refund dispute. It expressly left room for deductions supported by credible evidence of genuinely incurred expenses; the judgment does not make every visa-related cancellation fully refundable.
Identify who received the money
Bring receipts, bank transfers and mobile money records. Match them to the person or company named in the quotation and booking correspondence. A trading name on a social media account may differ from the legal entity that accepted payment. The correct party should be established before a demand is sent.
Record whether you paid the airline directly or paid an intermediary to arrange tickets. Explain whether separate amounts were charged for visa assistance, insurance or accommodation. A combined package needs a breakdown before the adviser can determine which service and which payment remain disputed.
Preserve the full conversation about the route and transit requirements. Include what you were told before paying, what documents you supplied and when the refusal was communicated. Avoid assuming that a refund dispute automatically proves the agent was responsible for the visa outcome.
Distinguish a booking from an issued ticket
Collect the itinerary, booking reference, ticket number and any airline confirmation. Note whether the document describes a reservation, an issued ticket or a cancelled segment. Ask the lawyer to compare the records rather than treating every travel document as proof that funds reached the carrier.
Keep the fare terms supplied when you agreed to buy. Later terms downloaded from a website may not be the terms accepted for the particular transaction. Record when the conditions were provided and whether cancellation charges were specifically explained in correspondence.
If the agent says money was remitted, request the records supporting that position. Relevant material may include payment confirmation and airline correspondence about cancellation. A general explanation of how agencies usually operate does not resolve what happened to your particular payment.

Make a schedule showing the original payment, each proposed charge, any partial refund and the disputed balance. Keep the currency and exchange calculation visible. If the agent describes one fee in dollars and another in shillings, ask how the final refund was calculated.
Separate airline penalties from the agent's own service charges. Identify the contractual basis and evidence offered for each. An adviser should assess whether the claimed expense was actually incurred, whether it relates to your booking and whether the agreed terms support passing it on to you.
Avoid treating an unexplained deduction as proof of criminal conduct. A civil refund claim should identify the amount and the evidence needed to resolve it. Give the advocate any explanation already supplied, including documents that may justify part of the charge.
Prepare a focused demand and claim
State the remedy you want: an explanation, supporting records, repayment of a specified balance or a negotiated resolution. A demand should make the disputed calculation understandable. Include enough booking information to identify the transaction without circulating unnecessary passport details.
Preserve the agent's reply and any offer to pay. If you accept a partial payment, keep its stated purpose and the accompanying terms. Ask the lawyer whether proposed settlement wording affects your ability to pursue the remaining balance before signing it.
The forum depends on the actual claim, value and parties. A contractual dispute with an agent and a regulatory complaint about aviation operations may raise different questions. The advocate should assess that distinction using your documents rather than automatically sending every travel dispute to the same body.
For a first consultation in Nairobi, bring the payment trail, booking documents, original fare terms, visa chronology and deduction schedule. A lawyer can assess the disputed expenses, the evidence available and a proportionate route to seek the refund that can be supported.
