The car was advertised as low mileage, but its import inspection record shows a much higher reading. The dealer points to an as-is clause when you ask for your money back. A false mileage car refund lawyer or advocate in Nairobi should examine the representation made before purchase and the records that contradict it. An ordinary mechanical defect and a misleading description need different evidence.

What the Maritim appeal decided

The High Court upheld rescission: the purchaser was to return the vehicle and receive KSh 1,541,500, with appeal costs against the dealer. It found mileage misrepresentation despite the as-is clause. The text contains an inconsistency about authority to sell: its detailed analysis finds no breach of that condition, while its closing narrative says otherwise. This article relies on the mileage finding and upheld orders, rather than presenting lack of authority as a settled finding.

Capture the description that induced the purchase

Preserve the advertisement, messages, quotation and sale agreement. Identify the reading actually shown to you and who made the statement. A remembered conversation can matter, but the advocate needs to know which parts are documented and which depend on witness evidence.

Explain why mileage mattered to your decision. Did you compare this vehicle with another, ask specifically about prior use or negotiate on the stated reading? Keep contemporaneous messages. Avoid adding a claim that you would never have bought the car unless that accurately reflects what happened.

Identify any witness who attended the inspection or test drive. Ask them to describe what they saw in their own words. A coordinated account can create unnecessary credibility questions. The useful evidence is their actual recollection, including anything that may differ from yours.

Match records to the same vehicle

Use the chassis number to connect import documents, inspection certificates and service records. Registration details can change; the file should explain how each record relates to the vehicle purchased. Check the dates and source of the record before treating an online result as decisive evidence.

Retain the earliest service job card after purchase. It may record the displayed mileage before further repairs or changes. Request a complete copy, including the vehicle description and date. If a workshop document contains a discrepancy, raise it with your lawyer instead of silently correcting it.

Keep original electronic files and the route by which official records were obtained. A screenshot without its source may be harder to explain. Ask the advocate what supporting witness or certification is needed for the particular record; do not assume every printout will be accepted on the same basis.

Read the sale terms without losing the factual issue

Bring every page of the signed agreement. Highlight provisions about inspection, condition, description and claims after delivery. Your lawyer should assess those terms against the alleged statement and the evidence, rather than treating the words as-is as a complete answer before reviewing the transaction.

Separate questions about mechanical quality from questions about a false odometer reading. A repair invoice may show that the car failed, but it does not by itself show what the dealer represented at sale. Conversely, evidence of a misleading reading needs to be connected to your decision to buy.

If ownership or agency is also disputed, provide the registration search and written authority relied on by the seller. Avoid combining every dissatisfaction into an allegation of fraud. The advocate should identify which allegations have a factual basis and which remedies each can realistically support.

Plan the practical consequences of a refund claim

Record the purchase payments and any amount still unpaid. Keep repair expenses, towing charges and other losses in separate schedules. Explain what you seek to recover and why. Asking to unwind a sale is different from claiming the cost of fixing a vehicle you intend to retain.

Document the car's present location, condition and use since purchase. Tell the lawyer whether it has been resold, financed or substantially altered. A proposal to return the car should address what can actually be delivered, without promising a condition that no longer exists.

Preserve correspondence proposing a refund or replacement. Note any offer to inspect the car and your response. Before arranging a handover, discuss how receipt, payment and documents will be recorded. A practical settlement needs clear steps as well as an agreed amount.

For a Nairobi consultation, bring the sale description, payment records, chassis-linked history, earliest service documents and correspondence. An advocate can assess whether the evidence supports a specific misrepresentation claim, the appropriate forum and a workable return-and-refund remedy.
