This article analyses Republic v Tuiya & 2 others, explains the court’s decision and identifies practical records to prepare for a review of your situation.
A Nairobi wildlife sentence lawyer or advocate should check the offence of conviction and the sentence's commencement direction. In Republic v Tuiya, three defendants were sentenced after trial for possession of an endangered wildlife trophy. The original dealing allegation and the offence of conviction were different provisions.
The operative terms were five years
JKIA Law Courts imposed five years' imprisonment on each defendant, running from the date of arrest. It forfeited the elephant tusks and motorcycle to Kenya Wildlife Service and discharged the surety with return of the security document and lifting of the restriction.
The reproduced page's short outcome description refers to a seven-year appeal disposal. That passage belongs to a different High Court decision quoted in the sentencing reasons. Tuiya's own final order is the five-year sentence at paragraph 30. It was a trial-court sentence, not an appeal reducing these defendants' terms. The publication does not establish later release or the subsequent result of an appeal.
Identify the conviction provision
Supply the judgment, charge sheet and any recorded amendment or alternative finding. Explain which offence the court actually found proved. An advocate reviewing sentence needs the conviction provision rather than assume that the original wording of the charge remained the final basis of punishment.
Keep the judgment and sentencing remarks together while labelling them separately. The findings supporting conviction and the later assessment of punishment answer different questions. A review of the term imposed should not rely on a summary that merges those stages or borrows a result from a cited authority.
Build the custody chronology
List the arrest date, first appearance and periods actually spent in custody. Include available remand warrants, bond orders and release or surrender records. Where the person was released briefly during proceedings, identify that period expressly rather than describe the whole interval as uninterrupted detention.
Explain discrepancies between dates in different documents. The advocate can compare the records with the sentence's operative wording. A date appearing in an article is useful context but should not replace the official custody chronology when the question concerns computation of a particular person's term.
Read the commencement direction
Provide the complete sentencing order and mark the sentence imposed on each defendant. Identify any express direction concerning when the term begins. A historical statement that time was considered and an explicit commencement date may require different examination of the resulting calculation.
Supply any later correction, revision or appeal order affecting the term. Do not calculate a release date simply by adding years to an online report. The reviewing advocate needs the current operative documents and relevant custody information to assess whether an administrative computation raises a question requiring action.

Collect the material that was actually presented concerning age, health, family responsibilities or other circumstances. Label personal statements and supporting documents separately. The fact that another sentencing court discussed advanced age does not promise a non-custodial result in a different wildlife matter.
Provide the pre-sentence report and identify any inaccurate entry you want reviewed. The advocate can examine the account, statutory basis and sentence together. A probation recommendation is a recommendation; it should not be represented as a final order simply because it proposes a preferred outcome.
Check the property and surety orders
Supply inventories and ownership records for any object affected by forfeiture. Identify whether the concern involves an exhibit, vehicle or a security document deposited for bond. Those categories should not be merged, because the operative directions can send them to different destinations.
Keep the surety discharge and any later registry communication with the bond papers. A direction to return a document is separate from evidence it was collected. Explain any outstanding restriction or unresolved request using the latest record, so the adviser can assess implementation rather than assume it was completed.
For Nairobi advocate review, supply the conviction, sentence, custody chronology and any later order. Tuiya demonstrates the importance of reading the final disposal rather than a quoted appeal result. It gives no guaranteed reduction for another defendant and no automatic release calculation without the current court and custody records.
