A supplier repeatedly sends a car component that will not work with your vehicle, then disputes the refund after you return it. A wrong spare part refund lawyer or advocate in Nairobi should compare the requested specification, the supplied item and the return evidence. The question is not limited to whether someone used the word warranty.

What the Gichuhi appeal upheld

The High Court upheld the KSh 318,500 award, comprising KSh 143,500 and KSh 175,000 transactions, and ordered unsold differential oil returned. It corrected the second transaction's legal basis: the original express warranty had not been extended, but non-conforming goods still supported refund under implied sale conditions. The appeal otherwise failed, with costs against the seller. A factual credibility ground was struck out under the Small Claims appeal restriction.

Record what you ordered

Keep the quotation, invoice and messages identifying the component. Include the vehicle model and the relevant technical specification supplied to the seller. A part number or configuration requirement can be more useful than a general statement that the item was intended for your car.

Explain who selected the component and what advice the seller gave. If you relied on their expertise to source a suitable item, preserve that exchange. If you supplied a specific instruction, include it in full. The consultation should address the actual agreement and representations.

Distinguish successive orders. A replacement offered under the first transaction may differ from a separately quoted second purchase. Record each payment, quotation and delivery against the correct item so the remedy does not depend on an assumption that every dealing had identical terms.

Preserve the evidence of the mismatch

Obtain written diagnostic observations where possible, identifying the component tested and the reason it could not be used. Ask the technician to distinguish incompatibility from installation error or an unrelated vehicle fault. A statement that the car still fails does not automatically establish a defective supply.

Keep photographs of labels, packaging and the item itself. Record the dates of tests and the people who performed them. If several garages were involved, organise their findings chronologically rather than combining them into an unattributed opinion.

Avoid altering or disposing of the component before advice if its condition remains disputed. If work was necessary, document what was done and why. Evidence of the item before and after testing can help explain whether an alleged defect existed on delivery.

Document rejection and return

Keep your notification to the seller, their response and the return receipt. Identify the person accepting delivery and the date. A refund claim becomes harder to assess if the parties disagree about whether the item was returned or remained in use.

Explain any delay between delivery, diagnosis and rejection. Testing may take time, but the chronology should be supported. Do not invent an earlier complaint date to strengthen your position. The adviser can assess the actual sequence and any issues concerning acceptance.

If the seller resold or disposed of the item, preserve their admission or other reliable evidence. Do not speculate about the resale price. Accounting for returned goods may matter, and a proposed deduction should be examined against the record rather than accepted from an unexplained estimate.

Check warranty and sale remedies separately

Supply the exact assurance and identify who made it. A warranty can be recorded in correspondence without appearing on a formal manufacturer's certificate. Its duration, subject and conditions should still be established from the words actually used.

Ask whether the assurance covered the particular transaction now disputed. Continued dealings do not necessarily extend an earlier promise. At the same time, an absence of an express warranty does not answer every question about conformity and implied sale obligations.

Separate the purchase price from diagnostic expenses, labour, transport and lost income. Keep receipts for each additional item and explain the connection. A successful refund argument does not automatically prove all consequential losses, especially sums supported only by your estimate.

If judgment has already been delivered

Provide the claim, response, proceedings, exhibits and judgment. An appeal from the Small Claims Court requires a legal issue; disagreeing with which witness was believed is not enough on its own. Identify the alleged error for your advocate without rewriting the trial evidence.

For an initial enquiry, bring a transaction schedule and the strongest documents showing specification, payment, incompatibility and return. A Nairobi advocate can then assess the proper claim, realistic amount and evidence needed to pursue a spare part purchase refund.
