An advocate confirms availability, scope and fees before accepting your matter.A Nyamira property lawyer or advocate for a demolition dispute must prove both interference with the land and the amount of loss claimed. In Nyamao v Nyamira County Government, the owner obtained an injunction, KSh 3,740,000 compensation and KSh 150,000 trespass damages. The court nevertheless rejected the much larger valuation of the destruction.
The county’s road works affected a developed private parcel
The claim concerned West Mugirango/Siamani/2137. The owner described demolition of buildings, a perimeter wall and gate, followed by excavation to create access. He relied on his title, registry records and professional reports. The county did not call witnesses after the plaintiff’s evidence closed.
The surveyor’s evidence placed the demolished buildings outside the road reserve. At paragraphs 8–9, the judge accepted that the county had destroyed structures on the plaintiff’s property without notice or appropriate ownership checks and found unlawful trespass.
Absence of defence witnesses did not validate every figure
The plaintiff’s asserted special damages exceeded KSh 11 million. The quantity surveyor described buildings no longer habitable and recommended reconstruction. However, at paragraph 10, the judge considered the figures exaggerated and identified weak photographs and the absence of proper local comparables.
The court awarded KSh 2,500,000 for the storey building and KSh 800,000 for the bungalow instead of the claimed amounts. Success on liability therefore did not produce automatic acceptance of the quantum. An advocate reviewing the file must assess the evidence supporting each component separately.
Someone seeking an advocate for demolition compensation in Nyamira should retain dated photographs, approved plans if available, measurements, construction records and the underlying basis of any expert estimate. The advocate needs to know whether a report values repair, rebuilding or the property as a whole.
Excavation and professional fees were separate components
Paragraph 11 addressed the excavated land and improvement work. The court noted that no soil specialist had established restoration cost, no witness explained the amount of soil removed and clear photographs were lacking. It awarded KSh 350,000 under the land-value and improvement heads.
Professional fees of KSh 90,000 were also allowed. These components, together with the building awards, produced KSh 3,740,000 compensation. The KSh 150,000 awarded for general and aggravated trespass damages was additional, rather than included within that compensation figure.
A schedule should identify the calculation and supporting document for each head. A single large estimate can conceal overlapping claims or uncertainty about the actual damage. The judgment illustrates why professional involvement alone does not remove the need for a persuasive factual basis.
The permanent injunction protected against further interference
The final orders at paragraph 14 restrained further entry, demolition, excavation and road construction on the identified parcel, among other interference. Costs were awarded. The judgment does not establish that the county later paid the monetary award or complied with every restriction.
The interest wording in the reported final order contains internal cross-reference problems. It expressly links interest on the trespass award to the filing date, but the remaining references are not coherent. This article does not replace that wording with an invented interest calculation. An enforcement review needs the extracted decree and any clarification.

The ownership and survey evidence supported the finding of wrongful interference. The reports and photographs addressed the separate question of compensation. Updated orders, payment records and any appeal or stay would address a third question: what can presently be enforced.
The plaintiff acknowledged gaps in building approvals during cross-examination. That admission should not be hidden, but neither should it be presented as a defence the court accepted to justify the demolition. The operative result was an injunction and monetary relief against the county on this evidence.
