Decision analysed: In re Mutura — [2026] KEHC 4326 (KLR) — 5 March 2026

Court: High Court at Mombasa

The dispute

A trader petitioned for his own bankruptcy after a dispute over six repaired lorries and a demand for Kshs 6.2 million. Illness prevented work and further treatment required borrowing. The petition was supported by an affidavit and public notices; creditors did not oppose it.

What the Court decided

The Court adjudged the petitioner bankrupt and appointed the Official Receiver or a nominee as bankruptcy trustee. It found inability to pay the debts on the evidence and notices. The judgment did not grant an immediate discharge from every debt or an unrestricted licence to deal with estate property.

What this decision does and does not establish

Personal bankruptcy is governed by Part III of the Insolvency Act and the applicable Regulations, not company-liquidation forms. Complete assets, liabilities, creditors, security and income disclosure is necessary. Illness must be supported by genuine evidence; non-opposition does not excuse inaccurate disclosure. A bankruptcy order, appointment of trustee, treatment of particular assets or debts and later discharge are different questions.

Choose a document for the procedural task

Trader Unable to Pay Debts After Illness — Debtor Bankruptcy Petition

Use the applicable Insolvency Act and current Insolvency Regulations, the correct personal-bankruptcy or company-liquidation prescribed form, supporting affidavit and complete financial disclosure. Check jurisdiction, standing, notices, advertisement, service and actual Court directions. This is substantive wording, not a completed statutory filing pack. Substantive particulars, not a complete prescribed petition. Verify sections 32–33, the current Regulations, statement-of-affairs requirements and Court notice directions. Medical evidence and financial records are not included. Apply the relevant personal-bankruptcy or corporate-liquidation provisions and prescribed procedure, rather than treating every insolvency application as an ordinary civil motion.

Illness and Inability to Pay Trading Debts — Debtor Supporting Affidavit

Complete the deponent identity, authority and actual personal-knowledge or identified-information basis. Index and authenticate genuine exhibits; missing exhibits are not supplied by this text. An affidavit is evidence, not a vehicle for new unpleaded relief or invented expert conclusions. Obtain any required leave for a further affidavit and complete a valid jurat before a competent authorised person. This specimen is unsworn. Apply the relevant personal-bankruptcy or corporate-liquidation provisions and prescribed procedure, rather than treating every insolvency application as an ordinary civil motion.

Personal Bankruptcy — Assets, Creditors and Income Disclosure Schedule

This is an evidential or accounting aid, not an originating process or independent proof. Give dates, authors or custodians, admissibility status, actual document pages and transparent calculations. Label missing and disputed items. Obtain the applicable leave or directions for supplementary evidence, serve it and prevent duplicate credits or recovery. Apply the relevant personal-bankruptcy or corporate-liquidation provisions and prescribed procedure, rather than treating every insolvency application as an ordinary civil motion.

Debtor Bankruptcy Notices — Affidavit of Actual Publication and Service

Complete the deponent identity, authority and actual personal-knowledge or identified-information basis. Index and authenticate genuine exhibits; missing exhibits are not supplied by this text. An affidavit is evidence, not a vehicle for new unpleaded relief or invented expert conclusions. Obtain any required leave for a further affidavit and complete a valid jurat before a competent authorised person. This specimen is unsworn. Separate procedural evidence aid. In the source petition Gazette and two newspaper notices were reported; their exact historical dates are not a universal notice timetable. No original service affidavit is supplied. Apply the relevant personal-bankruptcy or corporate-liquidation provisions and prescribed procedure, rather than treating every insolvency application as an ordinary civil motion.

Unopposed Debtor Bankruptcy — Submissions on Inability to Pay and Trustee

Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding. Apply the relevant personal-bankruptcy or corporate-liquidation provisions and prescribed procedure, rather than treating every insolvency application as an ordinary civil motion.
