In Keya v Adingo, the appellate court set aside a dismissal based on a preliminary objection. It directed a hearing on the merits at Hamisi. That restored the opportunity to pursue the claim without deciding who ultimately owned the land.
The objection relied on earlier land litigation
The appellant sued as an estate representative concerning Tiriki/Senende/34. The respondent raised res judicata and territorial jurisdiction. The trial court upheld the objection, dismissing the suit.
The appeal challenged that disposal. The parties’ competing ownership and occupation accounts remained background to the procedural question; they were not finally resolved by this judgment.
The earlier court file was needed
At paragraphs 22–25, the judge found that the earlier Hamisi pleadings, proceedings and judgment had not been placed before the trial court to establish all the necessary ingredients. The asserted relationship between parties also required evidence.
A review should obtain the actual prior file rather than rely on a case number or someone’s account of its result. Collect the originating claim, amended pleadings, final order and documents identifying the parties’ capacities. Explain whether the earlier litigant acted personally, for an estate or in another representative capacity.
Separate a legal objection from disputed facts
The court explained that a preliminary objection must meet the requirements for a pure point of law. It found that the objection here required inquiry beyond the pleadings.
For a review enquiry, list the facts said to be agreed and those contested. Put the supporting document beside each entry. This helps the advocate assess whether a proposed objection can be determined on its stated basis or requires an evidential process. The outcome of this appeal does not mean that every res judicata argument is unsuitable for preliminary determination.
The court restored the suit and transferred it
Paragraph 28 set aside the challenged ruling and directed a merits hearing. Because territorial jurisdiction was contested, the matter was transferred to Hamisi for hearing and disposal. Each party bore their own appeal costs.
The court also discharged earlier interlocutory orders in the appeal. It did not award title or compensation. A successful appeal against dismissal should therefore be described as restoring the litigation, with the remaining ownership questions still requiring determination.

Someone searching for an advocate to appeal a land case dismissal in Vihiga should provide every interim order as well as the final appellate decree. Record the order’s wording, court, date and any stated duration. Avoid assuming that a restraint continues merely because the suit has been revived.
For a transferred file, include the old and new case references and any receiving-court directions. The advocate needs to establish the current procedural position before advising on a hearing, application or response. Historic directions should not be described as current appointments.
Prepare the underlying claim for hearing
Restoration of the suit makes the evidence file important again. Organise the asserted acquisition, estate authority, registration history and occupation records in a dated sequence. Identify which witness can explain each disputed event and which document was actually filed.
State the final remedies sought and the evidence supporting each. A procedural victory may remove an obstacle to hearing, but the substantive claim still needs its own proof. Keep that distinction clear when assessing the practical value of an appeal or explaining its outcome to family members.
