This article analyses Mwaropo v Shaban & 3 others, decided by Voi High Court.
The transfer ruling did not determine the money claim
Voi High Court allowed the application to transfer Voi CMCC E173 of 2023 to the Kadhi’s Court and assessed application costs at Ksh 10,000 payable by the respondent. The dispute concerned money said to arise from inherited property sold under earlier Kadhi succession directions. The ruling decided the forum application, not whether each beneficiary had received the correct amount. The published discussion includes competing positions on submission to jurisdiction; the transfer order should not be expanded into a universal rule that all family money claims belong before a Kadhi.
Start with the order authorising the property sale
An inherited property sale proceeds lawyer needs the succession judgment, sale direction and relevant grant documents. An advocate should see the property identified and the distribution actually ordered. Supply the complete directions and any later variation. A family recollection that everyone agreed to a sale may not establish the terms on which the proceeds were to be handled.
Keep the court order separate from the sale agreement. Identify any condition that connects them. A lawyer needs to compare the authority asserted with the transaction carried out. The existence of an earlier succession file does not alone establish that every later payment or sale complied with its directions.
Reconstruct the money received and distributed
Prepare an account supported by receipts, statements and payment acknowledgments. Identify the sale price, deductions asserted and amounts paid to each claimant. An advocate needs to distinguish a documented credit from an estimate or disputed payment. An unexplained total may conceal the precise balance for which advice is sought.
Explain missing records and retain the available originals. A lawyer can review the factual basis of the account. The transfer ruling in Mwaropo does not prove that the administrator withheld money or that the beneficiaries’ claimed amounts were already judicially established.
Supply the civil claim and the succession record together
Bring the plaint, response and applications in the civil suit alongside the connected succession papers. Identify the relief sought in each. A lawyer needs to assess whether the civil dispute concerns payment under an existing direction or asks the court to decide a new inheritance issue. The parties’ family relationship should not substitute for those documents.
Include the relevant judgments and pending applications. An advocate can examine how the files overlap. The court’s order transferring this suit did not reopen every earlier succession finding or determine a new share for each family member.

Send the transfer application, affidavits and opposition. Identify the position taken on submission to Kadhi jurisdiction and the response given. An advocate needs the recorded dispute when examining the result. Do not turn a statement in an affidavit into a general proposition accepted by the court on every aspect of the matter.
Bring any later appeal or review papers if they exist. A lawyer can assess the operative position. A party’s preference for the magistrate’s court or Kadhi’s Court does not by itself determine what should happen in another case with different pleadings and procedural history.
Check the receiving file and the next hearing step
Supply the transfer order and communication showing whether the file was received and listed. Identify its current number and any dates. A lawyer needs to distinguish an order directing transfer from completion of the transfer and from determination of the substantive claim. Keep an application cost award separate from the sale proceeds in your account.
For consultation, send the sale authority, transaction account, civil pleadings and transfer papers together. State the particular balance or order you dispute. A lawyer and advocate can assess the Voi Kadhi connection and High Court ruling. Mwaropo records transfer of one civil suit; it does not establish an unpaid inheritance amount, guarantee recovery or prove that a particular beneficiary received the share ordered.
