Looking for a lawyer or advocate for group savings withheld for guaranteed loans at Bungoma High Court? This guide explains Wonderful Women Group & 2 others v Nafula and the documents to prepare for an independent consultation.

The appeal removed the savings refund award

Bungoma High Court overturned the Webuye savings refund judgment. It struck out the claims against the unincorporated group and unnamed office for lack of legal capacity, and dismissed the claim against the financial institution on the evidence. The court found that the member's own loan and guaranteed obligation exhausted her savings under the agreements. The respondent was ordered to bear trial and appeal costs. An electronic-evidence objection first raised in appeal submissions failed on this record. The decision does not permit every lender to take savings without examining the particular guarantee and account history.

Bring the group constitution that governed your membership

A lawyer for group savings withheld against guaranteed loans needs the constitution, membership papers and any later amendments. An advocate should compare the version in force when you joined, borrowed and guaranteed another member. Keep rules about withdrawal, savings and security separately identified. Explain whether you received the document and whether the group records refer to a different version.

Collect meeting resolutions or correspondence relevant to the deduction. Do not substitute an oral recollection for the written term relied upon. State what you dispute and why. The consultation should establish the actual contractual record before assessing the refund claim. This guide does not certify a group's rules or decide whether a deduction in your account was authorised.

Separate your own loan from each guarantee

Prepare one schedule for your borrowing and a different schedule for each loan you guaranteed. Include the signed guarantee, amount, borrower, payments and claimed balance. A lawyer needs to assess the scope of the undertaking, including whether it is limited or expressed jointly with others. Do not assume that every member owes an equal fraction of a defaulted loan.

List the co-guarantors and the evidence you hold about their payments without publishing private account details. An advocate can assess any issue of contribution separately from the lender's claim. Your own loan being paid does not alone explain the status of a guarantee, and another person's default should not be assumed without the relevant account records.

Reconcile the savings before and after the disputed deduction

Bring savings statements, passbooks, deposits, withdrawal records and the group's closing account. A lawyer should be able to trace the opening credit, each deduction and the amount you say remains refundable. Identify the date used in each statement. A balance at membership withdrawal may differ from a later balance after an adjustment or payment.

Attach the document supporting every entry in your calculation. Where figures conflict, mark the difference rather than choosing the favourable version. An advocate needs both accounts to evaluate the dispute. Do not describe the whole original savings amount as recoverable until the contractual deductions and evidence have been reviewed; this article does not calculate your entitlement.

Check the identity of the party you intend to sue

Collect the registration information and documents identifying the group, lender and people involved. A lawyer needs to distinguish an identifiable institution described inaccurately from an unincorporated body or an unnamed office. The name on a meeting list may not explain the party against whom an enforceable order is sought.

If a claim is already filed, bring its exact party descriptions and the response. An advocate should assess any capacity issue and available procedural step using the current record. Do not assume that participation in the hearing fixes every defect. The legal identity question should be reviewed independently of whether you believe the savings calculation is wrong.

Preserve the account report and its production history

Keep the original electronic report where available and record how you obtained the copy. Include the trial exhibits, hearing record and objections if the dispute has reached court. A lawyer needs to assess both what the report shows and how it was introduced. An entry overlooked in a judgment may be a different issue from an objection to its admissibility.

Identify discrepancies in member numbers, loan references and balances without changing the report. Ask an advocate to review the evidential requirements and timing of any objection. This case does not establish a general exemption from electronic-evidence requirements. Its appeal outcome depended on the particular record and the stage at which the objection was raised.

Send an enquiry about the remaining savings balance

Use “Webuye group savings withheld for another member's loan — lawyer and advocate review”. State your own borrowing, guarantee, membership exit and disputed deduction. Supply the constitution, guarantees, account schedules and court papers privately. Ask for assessment of the proper parties, evidence, refund or contribution route and fees. Identify any hearing or order requiring attention. Seeking advice does not suspend an existing costs order or guarantee recovery.
