Court: Environment and Land Court at Nyeri
The dispute
A registered purchaser claimed the builder had occupied the wrong one of two adjoining subdivisions. Both measured about 0.10 hectares. Mutation and registry-map evidence placed the claimant plot beside the road. The Karatina land trial dismissed the claim and gave the builder ownership without a counterclaim. The Nyeri ELC heard the first appeal; virtual delivery from Mombasa did not change the court station.
What the Court decided
The appeal succeeded. The Court allowed the trespass claim, awarded KES 300,000 general damages and trial and appeal costs, and rejected the unsupported exchange of parcel identities. The relief arose from this pleaded and proved dispute, not a universal award for encroachment.

Distinguish title number, physical plot and survey evidence. An unpleaded ownership claim cannot become a decree through submissions. The report has inconsistent dates for an earlier construction order; verify the certified file before building a chronology or enforcing relief.
Choose a document for the procedural task
Plaint for Construction on the Wrong Roadside Plot
Complete parties, addresses for service, material jurisdiction and limitation facts, precise negligence or other particulars, related proceedings and prayers. Check Orders 3 and 4 for the required verifying affidavit, witness statements, list and copies of documents; complete summons, fee and lawful service. Special damages require particular pleading and proof. This specimen is substantive wording, not the entire filing pack.
Defence Alleging a Parcel Numbering Error — Unsuccessful Source Position
Answer the actual numbered plaint with precise admissions, denials and material grounds. Check summons, appearance, the applicable response period, court directions and the required witness/document pack. A counterclaim or new affirmative relief requires its own proper pleading, fee and service. Do not treat a disputed factual allegation as a pure preliminary objection. The source appellate court rejected the numbering-error position and the unpleaded ownership result. This is a losing argument, not a recommended workaround.
Registered Owner Witness Statement Linking Mutation and Roadside Construction
Use the witness own truthful account, distinguish observed events from named information sources and identify bundle pages and authenticating witnesses. Follow the actual trial or succession witness directions. Additional evidence and statements require any applicable leave. An appeal ordinarily uses the admitted trial record; a new statement cannot be inserted without the proper procedure.
Memorandum of Appeal Against Unpleaded Ownership of an Adjacent Plot
Identify the exact lower-court judgment or ruling, operative decree, parties, concise grounds and requested disposition. Use the procedure for this particular appellate court: an ELRC appeal and a High Court or ELC first appeal are not Court of Appeal proceedings. Check limitation, any necessary leave or extension, record, fees, service and directions. Filing an appeal is not an automatic stay.
Appeal Submissions on Wrong Plot Construction and Relief Within Pleadings
Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding.

The original decision may identify participants; the specimens replace identifying details with bracketed fields. Losing positions remain marked unsuccessful.
