This article analyses Republic v Eshiwani & another, explains the court’s decision and identifies practical records to prepare for a review of your situation.
A Nairobi drug courier sentencing lawyer or advocate should identify whose plea and sentence are being considered. In Republic v Eshiwani, Carolyne changed her plea after some prosecution evidence had been heard. JKIA Law Courts sentenced her while the proceedings against the second accused continued.
Count-by-count orders mattered
For each of counts one and two, the court imposed a KSh 50 million fine, one year in default, and two years' imprisonment, with default imprisonment concurrent with the prison term. Count three carried a KSh 100 million fine and one year in default. The sentences across the counts were concurrent, and time in pre-trial detention was considered.
These were Carolyne's orders. They do not convict or sentence the second accused, whose trial remained pending. Nor should concurrency be paraphrased as automatic cancellation of the fines. The decision considered mitigation and the courier role without treating financial hardship as an acquittal. It does not prove later payment or the outcome of an appeal.
Separate the defendants' positions
Supply the charge sheet, plea entries and latest order for the person seeking advice. Where a co-accused has admitted charges, explain whether your own proceedings remain contested. A shared case heading does not establish that every defendant has the same plea, conviction or sentence.
Keep separate chronologies if the defendants reached different procedural stages. The advocate needs to see which hearing and order concerns which person. Avoid describing the entire case as concluded solely because one accused has been sentenced while another continues to face a trial.
Preserve the change-of-plea record
Provide the original plea, the later reading of the charge and the record of facts presented. Include any document concerning a proposed plea agreement. An attempt to negotiate and a completed recorded agreement are different events and should be described accurately.
Explain any concern about representation or comprehension to the reviewing adviser. The appropriate assessment depends on the actual file. This article does not tell an accused to admit an offence or promise a discount; a plea decision requires advice addressing that person's charge, evidence and recorded instructions.
Document the mitigation accurately
Supply the material supporting the personal circumstances already raised. Identify the basis of any account concerning employment, dependants or involvement in the alleged activity. Keep a defendant's statement, a relative's statement and a report entry separately attributed.
Where accounts differ, preserve the discrepancy for review rather than choose the more favourable version. The advocate can assess whether explanation or supporting material is needed. A general claim of hardship is not a substitute for the relevant documents, and its consideration does not guarantee the sentence requested.

Make a schedule of each count, fine, default term and substantive prison term in the operative order. Include the direction about concurrent or consecutive service exactly as recorded for review. Do not combine the entries into a simplified total that removes an obligation appearing in the order.
Supply any receipt, warrant or subsequent computation available. The adviser can assess what has been imposed and what has been complied with. Payment of one amount or completion of one step should not be presented as proof that every count has been discharged without the supporting record.
Check exhibits while a trial continues
Identify the personal belongings sought and the exhibit references in the file. The Eshiwani sentence expressly retained exhibits for the continuing proceedings against the other accused while making a separate direction concerning personal property not being used as exhibits.
Provide later orders and correspondence about custody of the items. A review should distinguish an object required for another defendant's trial from personal property subject to a return direction. Sentencing one person does not necessarily mean the evidence in the shared file can all be released immediately.
For Nairobi advocate review, state the defendant's role, plea history, count-specific sentence and next relevant date. Eshiwani illustrates one defendant's sentencing within a continuing prosecution. It offers no immunity based on a courier description, no automatic cancellation of fines and no finding of guilt against an accused whose trial was still ongoing.
