Source facts and limits of the decision

A resident sought protection against demolition on a claimed Mombasa parcel and purported to represent fifty-five others. The utility pointed to earlier litigation concerning a neighbouring parcel, a refused 2019 interim application and a suit later dismissed for want of prosecution. The plaintiff supplied later undated lists containing sixty-one names. The utility own motion cited party-joinder provisions for relief that instead concerned vacating interim orders and striking out.

The Court dismissed the plaintiff motion, struck out the utility motion for its inappropriate procedural basis and vacated the interim status-quo order. It criticised non-disclosure, uncertainty over the parcel and missing contemporaneous authority. It treated the repeated interim issues as res judicata. It did not finally dismiss the entire substantive suit through the defective utility application or approve every future demolition.

Distinguish authority to act for named co-parties under Order 1 rule 13 from a representative action under rule 8. A dismissed main suit and an earlier decided interim issue require separate analysis under sections 6 and 7. Use the provision matching the specific relief: Order 40 rule 7 for discharge or variation of an injunction, with an appropriate application under Order 51. Do not copy the unsuccessful joinder-rule motion.
