Court: Environment and Land Court at Mombasa
The dispute
Forty occupiers sought title to approximately 3.790 hectares through adverse possession. They relied on longstanding occupation, photographs, a sketch of their portions and a title search. The registered proprietor did not appear after court-authorised substituted service; the Court heard formal proof.
What the Court decided
The Court declared the occupiers entitled through adverse possession and directed cancellation or rectification of the proprietor entries and registration of the forty successful applicants. There was no costs order. Non-appearance did not replace the applicants obligation to prove their claim.

Limitation of Actions Act sections 7 and 38 and Civil Procedure Order 37 rule 7 govern the substantive and originating-summons issues. Identify each claimant, legal capacity, occupied extent, commencement, continuity, lack of permission and possible interruption. Community registration in 2023 is not the start of each person occupation. The source refers both to over thirty years and entry in 1983; do not manufacture an identical start date for all forty.

Forty Occupiers Adverse Possession — Originating Summons
Use the competent ELC originating-summons process and Order 37 rule 7 for adverse possession. Supply the certified title extract, supporting affidavit, accurately identified claimants and land extent. Follow service and formal-proof directions; the specimen is not the entire filing pack. Use Order 37 rule 7, the required certified title extract and affidavit. Identify all applicants and their actual interests; a CBO certificate does not itself prove title or personal occupation.
Community Occupation Evidence — Supporting Affidavit for Adverse Possession
Complete the deponent identity, authority and actual personal-knowledge or identified-information basis. Index and authenticate genuine exhibits; missing exhibits are not supplied by this text. An affidavit is evidence, not a vehicle for new unpleaded relief or invented expert conclusions. Obtain any required leave for a further affidavit and complete a valid jurat before a competent authorised person. This specimen is unsworn.
Forty Adverse Possession Claimants — Occupation and Parcel Schedule
This is an evidential or accounting aid, not an originating process or independent proof. Give dates, authors or custodians, admissibility status, actual document pages and transparent calculations. Label missing and disputed items. Obtain the applicable leave or directions for supplementary evidence, serve it and prevent duplicate credits or recovery.
Untraceable Land Proprietor — Application for Substituted Service
Use the actual existing cause, applicable power and precise interim or substantive prayers with genuine supporting evidence. Disclose adverse facts, earlier applications, current orders and delay. Complete affidavit, exhibits, urgency certificate only where justified, fee and service under current directions. A proposed corrected motion does not establish that the missing facts or procedural permission exist. A reconstructed procedural step inspired by the source authorised substituted service; the source does not supply the actual efforts or order terms. Use genuine evidence and verify Order 5 rule 17 applicability.
Unopposed Adverse Possession — Formal Proof Written Submissions
Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding.

The primary judicial text, Mombasa heading, reasons and operative orders were checked. Each sample is newly drafted and uses bracketed specimen identities. Unsuccessful historical positions and proposed corrections are identified. No original filed wording, exhibits, subsequent-order assurance or licensed-advocate review is claimed. Check the authentic court file, current law and directions before use.
These documents are newly drafted educational reconstructions, not original filed pleadings or matters handled by our team. The original decision may identify participants; the specimens replace identifying details with bracketed fields. Losing positions remain marked unsuccessful. An advocate must adapt jurisdiction, evidence, prayers and procedure to the actual case.
