REPUBLIC OF KENYA
IN THE ENVIRONMENT AND LAND COURT AT MOMBASA
ENVIRONMENT AND LAND ORIGINATING SUMMONS NO [reference]
[NAMED OCCUPIER APPLICANTS] v [REGISTERED PROPRIETOR]
WRITTEN SUBMISSIONS
1. The Applicants rely on the admitted evidence proving their identified occupation and the certified register. The issues are the statutory period, character and continuity of possession, claimed extent and precise registration relief.
2. Sections 7 and 38 require a proved adverse-possession claim rather than a transfer by default. The evidence at [pages] shows when each relevant possession began, its open and non-permissive nature and the basis for continuity.
3. The photographs and sketch are used for the features and portions they actually demonstrate. The witness testimony explains the historic occupation. Registration of a community organisation does not fill an evidential gap concerning personal entry or interruption.
4. Lawful service is established by the actual order and proof of compliance at [pages]. The Respondent non-appearance allows the hearing to proceed under the proper directions but does not compel a declaration without evidence.
5. Kalama [2025] KEELC 5068, paragraphs 7–11, illustrates formal proof using title, occupation evidence and defined applicants. The Court must apply the statutory test to the present facts, including any lease, permission, competing interest or recovery event.
6. The Applicants seek the pleaded declaration and accurately specified registration directions for the persons and land proved, with a reasoned costs order. No new applicant, parcel or factual exhibit is introduced in these submissions.
DATED at [place] on [date]. Signed [party or advocate]. DRAWN AND FILED BY [name and address for service]. TO BE SERVED UPON [each affected person and address].

Use and evidence notes
Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding.
Supporting material: [date]; [author or custodian]; [description]; [bundle page]; [authenticating witness]; [admission or permission]. Attach genuine records only. This public specimen contains no exhibits, signatures, personal identifiers or sworn declaration.
Source facts and limits of the decision
Forty occupiers sought title to approximately 3.790 hectares through adverse possession. They relied on longstanding occupation, photographs, a sketch of their portions and a title search. The registered proprietor did not appear after court-authorised substituted service; the Court heard formal proof.
The Court declared the occupiers entitled through adverse possession and directed cancellation or rectification of the proprietor entries and registration of the forty successful applicants. There was no costs order. Non-appearance did not replace the applicants obligation to prove their claim.
Limitation of Actions Act sections 7 and 38 and Civil Procedure Order 37 rule 7 govern the substantive and originating-summons issues. Identify each claimant, legal capacity, occupied extent, commencement, continuity, lack of permission and possible interruption. Community registration in 2023 is not the start of each person occupation. The source refers both to over thirty years and entry in 1983; do not manufacture an identical start date for all forty.

The original decision may identify participants. The specimen replaces their identifying details. The primary judicial text, Mombasa heading, reasons and operative orders were checked. Each sample is newly drafted and uses bracketed specimen identities. Unsuccessful historical positions and proposed corrections are identified. No original filed wording, exhibits, subsequent-order assurance or licensed-advocate review is claimed. Check the authentic court file, current law and directions before use.
