REPUBLIC OF KENYA

IN THE EMPLOYMENT AND LABOUR RELATIONS COURT AT BUNGOMA

EMPLOYMENT AND LABOUR RELATIONS MISCELLANEOUS APPLICATION NO [reference]

[ESTATE REPRESENTATIVE APPLICANT] v [COUNTY EMPLOYER RESPONDENT]

EVIDENCE OR COMPUTATION SCHEDULE

1. This schedule separates the Director compensation award, burial expenses, payments and interest commencement for [actual application]. It is an accounting and evidence aid, not a replacement for the award, decree, receipts or sworn evidence.

2. COMPENSATION: enter the certified award amount, award date, Director reference, notification and any objection, appeal or stay. The source compensation was KES 6,364,800. Identify payments credited to that head and the current net balance.

3. BURIAL: list each genuine expense by date, supplier, service, payer, receipt and amount. Separate necessary burial expenditure from unsupported or duplicated items. Identify anonymous cash-sale receipts and the evidence needed to authenticate them.

4. CLAIM AND ORDER: record the amount requested and the amount actually allowed as distinct entries. The source request was KES 738,411, while the Court awarded KES 300,000. Neither number is a standard tariff or a substitute for the present estate proof.

5. INTEREST: identify the exact operative order and lawful rate if stated. In the source compensation interest began at the Director award date and burial-expense interest at the ruling date. Annual compounding was requested but not expressly granted; it must not be silently inserted into the account.

6. TOTAL: present each net head, costs actually assessed, authorised interest and the calculation cut-off. Credit each payment once. After adoption, any county-payment certificate and service are separate enforcement steps; this schedule does not authorise attachment or distribution of estate funds.

DATED at [place] on [date]. Signed [party or advocate]. DRAWN AND FILED BY [name and address for service]. TO BE SERVED UPON [each affected person and address].

Use and evidence notes

This is an evidential or accounting aid, not an originating process or independent proof. Give dates, authors or custodians, admissibility status, actual document pages and transparent calculations. Label missing and disputed items. Obtain the applicable leave or directions for supplementary evidence, serve it and prevent duplicate credits or recovery. Verify the ELRC Procedure Rules 2024 and 2025 amendments, or the applicable designated subordinate-court procedure, and current directions. Assess section 90 for each employment claim.

Supporting material: [date]; [author or custodian]; [description]; [bundle page]; [authenticating witness]; [admission or permission]. Attach genuine records only. This public specimen contains no exhibits, signatures, personal identifiers or sworn declaration.

Source facts and limits of the decision

An estate representative sought adoption of a DOSH fatal work-injury award of KES 6,364,800 and KES 738,411 funeral expenses. The award followed the work-related death within four months. The county challenged reporting, notice, liability and receipt authenticity without a recognised objection or appeal against the award. The employer accident form and award notification contradicted its notice account.

Bungoma ELRC adopted the KES 6,364,800 award, allowed KES 300,000 reasonable burial expenses and application costs, and directed a decree. Interest on compensation ran from the Director award date; interest on burial expenses ran from the ruling date. The signature records delivery at Kakamega, while the heading and judicial designation identify Bungoma ELRC.

Use ELRC Procedure Rules rule 69 and the proper WIBA award-adoption process, not a fresh original civil trial on the accident. Check the actual award, sections 26–27 reporting, section 34 burial expenses and sections 51–52 objection/appeal position. KES 300,000 is not a universal funeral tariff. Annual compounding appeared in the request but is not expressly granted in the operative orders.
