Decision analysed: Omuse (Estate of Magdalene Wamai Ekuot) v County Government of Busia — [2026] KEELRC 1633 (KLR) — 11 June 2026

Court: Employment and Labour Relations Court at Bungoma

The dispute

An estate representative sought adoption of a DOSH fatal work-injury award of KES 6,364,800 and KES 738,411 funeral expenses. The award followed the work-related death within four months. The county challenged reporting, notice, liability and receipt authenticity without a recognised objection or appeal against the award. The employer accident form and award notification contradicted its notice account.

What the Court decided

Bungoma ELRC adopted the KES 6,364,800 award, allowed KES 300,000 reasonable burial expenses and application costs, and directed a decree. Interest on compensation ran from the Director award date; interest on burial expenses ran from the ruling date. The signature records delivery at Kakamega, while the heading and judicial designation identify Bungoma ELRC.

What this decision does and does not establish

Use ELRC Procedure Rules rule 69 and the proper WIBA award-adoption process, not a fresh original civil trial on the accident. Check the actual award, sections 26–27 reporting, section 34 burial expenses and sections 51–52 objection/appeal position. KES 300,000 is not a universal funeral tariff. Annual compounding appeared in the request but is not expressly granted in the operative orders.

Choose a document for the procedural task

Motion to Adopt a Fatal Work Injury Award With Separate Burial Expenses

Use the actual existing cause, applicable power and precise interim or substantive prayers with genuine supporting evidence. Disclose adverse facts, earlier applications, current orders and delay. Complete affidavit, exhibits, urgency certificate only where justified, fee and service under current directions. A proposed corrected motion does not establish that the missing facts or procedural permission exist. Verify the ELRC Procedure Rules 2024 and 2025 amendments, or the applicable designated subordinate-court procedure, and current directions. Assess section 90 for each employment claim.

Estate Affidavit on Employer Accident Notice and DOSH Award Notification

Complete the deponent identity, authority and actual personal-knowledge or identified-information basis. Index and authenticate genuine exhibits; missing exhibits are not supplied by this text. An affidavit is evidence, not a vehicle for new unpleaded relief or invented expert conclusions. Obtain any required leave for a further affidavit and complete a valid jurat before a competent authorised person. This specimen is unsworn. Verify the ELRC Procedure Rules 2024 and 2025 amendments, or the applicable designated subordinate-court procedure, and current directions. Assess section 90 for each employment claim.

County Replying Affidavit Challenging Award Notice and Funeral Receipt Proof

Work Injury Adoption Schedule Separating Compensation Burial and Interest

This is an evidential or accounting aid, not an originating process or independent proof. Give dates, authors or custodians, admissibility status, actual document pages and transparent calculations. Label missing and disputed items. Obtain the applicable leave or directions for supplementary evidence, serve it and prevent duplicate credits or recovery. Verify the ELRC Procedure Rules 2024 and 2025 amendments, or the applicable designated subordinate-court procedure, and current directions. Assess section 90 for each employment claim.

Work Injury Adoption Submissions on Timely Award and Reasonable Burial Costs

Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding. Verify the ELRC Procedure Rules 2024 and 2025 amendments, or the applicable designated subordinate-court procedure, and current directions. Assess section 90 for each employment claim.
