REPUBLIC OF KENYA
IN THE ENVIRONMENT AND LAND COURT AT MOMBASA
CONSTITUTIONAL PETITION NO [reference]
[RESIDENT PETITIONERS] v [COUNTY RESPONDENTS]
WRITTEN SUBMISSIONS
1. The Petitioners distinguish the absence of a statutory liaison committee and an accessible planning framework from allegations about individual buildings. The institutional claim is supported by [official records]; specific environmental and permit allegations are assessed only on the evidence actually tendered.
2. PLUPA sections 76–78 provide county committee establishment, composition and functions. The source judgment different section numbers require checking against the Act. The pleaded constitutional connection is [access to the remedy and participation]. The Court must consider statutory routes and exhaustion for particular approval disputes rather than treating every planning complaint as immediately constitutional.
3. The reported Court did not accept photographs, an uninterpreted map and general infrastructure allegations as sufficient proof of all asserted violations. Relief cancelling particular approvals requires the identified decision, legal requirement, affected persons and admissible evidence.
4. Structural directions should identify the responsible county offices, obligation, justified compliance period and practical reporting mechanism. The source used 180 days for the framework, 90 for the committee and 45 for public sensitisation. These historical periods are not substituted for a fresh Court order.
5. The Petitioners request appropriate declarations and targeted directions on proved omissions. Unparticularised claims against the construction authority should be resolved separately. Costs remain discretionary under rule 26; the public-interest character does not guarantee costs recovery or success.

Use and evidence notes
Identify pleaded issues, admitted evidence and genuine record pages. Follow directions on length, authorities, filing and service. Submissions do not introduce exhibits or cure missing substantive prayers. Distinguish what a party sought from what the Court ordered, and an unsuccessful historical position from the actual holding.
Supporting material: [date]; [author or custodian]; [description]; [bundle page]; [authenticating witness]; [admission or permission]. Attach genuine records only. This public specimen contains no exhibits, signatures, personal identifiers or sworn declaration.
Source facts and limits of the decision
Fifteen residents challenged county development regulation, high-rise impacts and the absence of the statutory planning liaison committee. Photographs and a map did not sufficiently prove the particular approval, privacy, water, sewer and road violations alleged.
The petition partly succeeded. The Court ordered a development framework within 180 days, a liaison committee within 90 days and public sensitisation on the 2015–2035 strategic urban plan within 45 days. The construction authority was struck out as improperly joined and each party bore its costs.
The Court relied on Articles 10, 42, 47, 48, 50, 69 and 70. The judgment cites PLUPA sections 72–73, but the Act places county committee establishment, composition and functions in sections 76–78; that source numbering is not copied into the specimens. Individual development-approval challenges require the appropriate statutory remedy and precise evidence. The decision does not cancel all permits or establish present non-compliance with its historical deadlines.
