REPUBLIC OF KENYA
IN THE SMALL CLAIMS COURT AT MOMBASA
SMALL CLAIM NO [reference]
[SUPPLIER CLAIMANT] v [CUSTOMER RESPONDENT]
EVIDENCE OR COMPUTATION SCHEDULE
1. This schedule supports the actual Small Claims Court evidence exchange. For each invoice enter its genuine date, printer reference, period, opening and closing black and colour readings, unit rates, tax, amount, proof that counter information was available and authenticating witness.
2. For the source first machine example, 5,945 black pages at KES 2 plus 3,202 colour pages at KES 10 yields KES 43,910 before VAT and KES 50,935.60 including sixteen-percent VAT. The next 104 black and 146 colour pages yields KES 1,934.88 on that historical tax basis.
3. Link each replacement machine to its genuine installation, closing and opening records. Do not add successive cumulative meter totals together. Photographs and print-outs must identify the actual machine and period through reliable accompanying records, not invented identifiers.
4. Separate page rental, ordinary maintenance, alleged misuse repair, late-payment charges and uplifting. State the contractual basis and supporting evidence for each. The source excluded KES 17,400 uplifting from KES 471,397.69, leaving KES 453,997.69.
5. Credit each verified payment once, including the source later KES 77,436 cheque. Arithmetic from the decimal trial award yields KES 376,561.69, while the operative appeal order states the secured sum as KES 376,561. Preserve that discrepancy for reconciliation against the sealed decree and actual bank records.
6. Mark missing, disputed or clarified entries expressly. This is an evidential accounting aid and not proof of the contract, VAT status or future tax rate. Deposit interest and appeal costs must remain separate from invoice principal and be governed by the actual orders.

Source facts and limits of the decision
A printer supplier claimed KES 471,397.69 for page-count charges, repair, late-payment charges and uplifting. The customer disputed counter documentation, repair liability and fees. The trial court excluded KES 17,400 uplifting and awarded KES 453,997.69. A later KES 77,436 cheque was credited, and a balance was secured during appeal.
The High Court dismissed the appeal. The contracts required counter information to be available, not a prescribed document format as a condition precedent. The customer own bundle supplied supporting readings. The operative order released KES 376,561 plus accrued deposit interest to the supplier and awarded appeal costs.
Section 38 of the Small Claims Court Act confines appeal to matters of law; the High Court did not rehear factual credibility. Distinguish repair due to proven misuse from ordinary maintenance, contractual penalties from invented fees, and trial proof from summary judgment on admissions. The source rounds the deposit balance to KES 376,561 despite decimal trial figures; reconcile the sealed decree and bank records.
