REPUBLIC OF KENYA
IN THE SUPREME COURT OF KENYA
PETITION OR APPLICATION NO [reference]
[APPELLANT OR APPLICANT] v [RESPONDENT]
WRITTEN SUBMISSIONS
1. These submissions reconstruct the regulator’s unsuccessful case. The Court must first identify the decision challenged and the statutory power claimed for refusing the proposed names.
2. The Appellant relies on its historical regulatory mandate. It must explain how that mandate applied to name reservation and how a refusal satisfied constitutional protection of association and equality.
3. Reliance on criminal law provisions requires a reasoned connection to the proposed lawful objects. A refusal cannot be justified merely by suggesting that all potential members have committed an offence.
4. The limitation argument must address the nature, extent and justification of the restriction. A minority judicial view in the source is not to be presented as the majority holding.
5. The Appellant’s exhaustion contention must name the actual statutory mechanism and explain its applicability to a name decision. Current PBO registration procedures require fresh examination.
DATED at [place] on [date]. Signed [party or advocate]. DRAWN AND FILED BY [name and address for service]. TO BE SERVED UPON [each affected party and address].

Use and evidence notes
Put evidence in the admitted record and identify page references for every material factual proposition. Submissions do not introduce evidence. Check the Court’s directions on filing, length, authorities and service. Address jurisdiction before merits, answer the opponent’s actual objection and state the requested disposition. If the source argument failed, explain why rather than describing it as a successful precedent.
Authorities and record references: [authority and proposition]; [relevant admitted document and page]; [court direction governing this filing].
Source facts and limits of the decision
An applicant proposed names for an organisation advocating the rights of sexual minorities. The regulator refused name reservation by relying on criminal law provisions. The High Court and Court of Appeal found violations of association and equality rights. The regulator appealed to the Supreme Court.
The Supreme Court dismissed the appeal by majority and awarded costs to the first respondent. The decision concerned association and discriminatory name refusal; it did not decriminalise offences or legalise same sex marriage. The dissents were not the binding disposition.
Constitution Articles 27, 36 and 163(4)(a); applicable limitation analysis; availability of an actual internal remedy. The source dealt with the historical NGO regime. For a new filing, verify the Public Benefit Organisations Act framework and current regulator and appeal provisions rather than reuse an obsolete agency name.
