REPUBLIC OF KENYA

IN THE SUPREME COURT OF KENYA

PETITION OR APPLICATION NO [reference]

[APPELLANT OR APPLICANT] v [RESPONDENT]

WRITTEN SUBMISSIONS

1. The dispute concerns equal access to forming a rights advocacy association. It does not ask this Court to decide the legality of all conduct associated with any proposed member.

2. Articles 27 and 36 protect persons whose views or identity may be unpopular. The refusal reasons must be measured against those protections and the requirements for lawful limitation.

3. The regulator must identify a statutory basis that actually authorises the name refusal. Criminal provisions cannot be treated as a general permission to deny association based solely on identity.

4. The historical name reservation step did not carry the internal remedy asserted for registration decisions. Exhaustion is assessed against the legal mechanism actually available, rather than an assumed one.

5. The Respondent requests dismissal and costs. The majority disposition must be distinguished from the dissents, and the constitutional result must not be described as decriminalisation or marriage recognition.

DATED at [place] on [date]. Signed [party or advocate]. DRAWN AND FILED BY [name and address for service]. TO BE SERVED UPON [each affected party and address].

Educational reconstruction from a reported decision. Newly drafted sample, not an original filing or a matter handled by our team. Identifying details are replaced with bracketed fields. Verify the facts, law, jurisdiction and court directions before use.

Use and evidence notes

Answer the actual pleaded grounds and the Appellant’s authorities. Identify the record pages relied upon and any genuine limits of jurisdiction. An argument that failed in the source case remains marked historical. New affirmative relief may require a cross-appeal; do not obtain it by adding a prayer to submissions. Follow current filing, bundle and service directions.

Authorities and record references: [authority and proposition]; [relevant admitted document and page]; [court direction governing this filing].

Source facts and limits of the decision

An applicant proposed names for an organisation advocating the rights of sexual minorities. The regulator refused name reservation by relying on criminal law provisions. The High Court and Court of Appeal found violations of association and equality rights. The regulator appealed to the Supreme Court.

The Supreme Court dismissed the appeal by majority and awarded costs to the first respondent. The decision concerned association and discriminatory name refusal; it did not decriminalise offences or legalise same sex marriage. The dissents were not the binding disposition.

Constitution Articles 27, 36 and 163(4)(a); applicable limitation analysis; availability of an actual internal remedy. The source dealt with the historical NGO regime. For a new filing, verify the Public Benefit Organisations Act framework and current regulator and appeal provisions rather than reuse an obsolete agency name.
