64. Offences relating to transport

(1)A person shall not—

(a)undertake the design of any packaging or package;

(b)operate or maintain any packaging or package; or

(c)transport, or cause or permit to be transported in any packaging or package, any nuclear material or radiation source, otherwise than in accordance with the provisions of this Act.

(2)A person who contravenes the provisions of subsection (1) commits an offence and is liable on conviction, to a fine not exceeding five million shillings or imprisonment for a term not exceeding five years or to both.
