8. Gifts.
(1)For purposes of section 16(2)(d) of the Act, the value of a gift that a public officer may receive shall not exceed twenty thousand shillings.(2)A public officer shall not receive a gift offered by the same donor more than twice in a financial year.(3)Any gift received by a public officer that is not within the category of gifts that are exempted under section 16(2) shall be deemed as a gift to the State and shall be surrendered to the reporting authority of the public officer.(4)A gift that is surrendered to the reporting authority under paragraph (3) may be utilized by the reporting entity or disposed of in accordance with the Public Procurement and Asset Disposal Act (Cap. 412C).(5)A person who contravenes paragraph (2) commits an offence and shall on conviction be liable to a fine not exceeding twenty thousand shillings or a term of imprisonment not exceeding six months or to both.
