In Mutunkei & another v Noonkanas & another, Kajiado ELC considered that conflict at an interim stage, rejected a limitation objection and preserved the land for a full hearing.
The plaintiffs challenged a subdivision and transfer chain
The original land was Kjd/Mailua/1146, described as family property allocated through dissolution of Mailua Group Ranch. It had been registered to the second plaintiff, the family head.
The plaintiffs said the property was subdivided and parcel Kjd/Mailua/2058 transferred first to one defendant and then to another. They alleged that the family trust, spousal interest and relevant consent requirements had not been respected.
The second plaintiff’s account was that he had agreed to lease 50 acres for a recreation camp, not sell it. He denied signing a valid sale agreement, receiving the sale consideration or obtaining the asserted subdivision and sale consents.
The buyer relied on an older agreement and registered title
The second defendant said he purchased the disputed portion from the first defendant under a November 2010 agreement and received a title in April 2011. He claimed purchaser protection and opposed the requested injunction.
He also raised a preliminary objection, arguing that the 2024 suit was outside the period for bringing a land-recovery claim. The court considered that objection alongside the preservation application.
This chronology made the timing of discovery important. The plaintiffs expressly pleaded that they discovered the alleged fraud only in 2024 when the later purchaser appeared to establish a camp.
The court applied the fraud-discovery limitation provision
At paragraphs 16–18, the court identified particularised fraud as the pleaded cause of action and considered section 26 of the Limitation of Actions Act. It held that the pleaded 2024 discovery defeated the time-bar objection at this stage.
The court said the plausibility of the fraud particulars required a hearing. It therefore rejected the objection and permitted the suit to proceed.
This ruling should not be converted into a general assurance that every old land claim becomes timely by alleging recent discovery. A live file requires assessment of the actual discovery evidence, available inquiries and applicable limitation provisions.
The land was preserved without a final fraud determination
The court noted that the disputed portion came from the second plaintiff’s original parcel. His denials about sale, signature, consent and consideration had not then been answered by contrary evidence sufficient to remove the genuine question presented.
The judge found a prima facie case, a risk of irreparable harm and a balance of convenience supporting an injunction. The ruling allowed the plaintiffs’ application restraining dealings that would change the disputed land’s position pending trial.
It did not cancel the buyer’s title, finally establish the family’s fraud account or award a monetary remedy. The interim findings were directed to preserving the dispute’s subject matter.

A lease and a sale can involve very different rights even when the landholder allows another person onto the property. The dispute here illustrates why an advocate must obtain the actual agreement and registration documents.
Correspondence describing the camp’s purpose, payments, consent records and witnesses to the transaction can help establish what was authorised. The later title does not answer every question about the originating agreement.
Where family trust or spousal interests are asserted, the relevant beneficial ownership and consent account also needs its own factual foundation. Those assertions remained matters for substantive examination in this case.
Preparing a Kajiado land-fraud file
- The original allocation and title for the mother parcel.
- The agreement said to authorise occupation or sale.
- Subdivision, transfer and consent records.
- Payment evidence for rent or purchase consideration.
- A dated account of discovery and subsequent inquiries.
- Evidence of threatened disposal or further development.
The injunction and limitation questions should be prepared separately. One concerns preservation pending trial; the other concerns whether the claim can be heard. Winning both preliminary issues does not remove the need to prove the substantive case.
