A Kwale property advocate or land lawyer reviewing disputed rental income should separate preservation of future receipts from recovery of past rent. In Stuart v Mwalimo, the court protected properties associated with a deceased’s estate and directed rent collection through an agent for deposit in court. It expressly declined to order repayment of the historical rent claimed.

The application concerned three income-producing properties

The dispute involved Kwale/Diani Beach Block/683 and 684 and Kwale/Ukunda/397. The applicant said he held title in trust for the estate and beneficiaries and challenged the respondents’ control and rent collection. The respondents disputed his authority and raised the connection with succession proceedings.

The judge considered the earlier succession record, consent and power-of-attorney material in assessing standing. It found a sufficient basis for the applicant to bring this preservation proceeding. That finding should not become a general claim that financing another family’s litigation always authorises someone to administer its estate.

The ownership merits remained for the substantive hearing

The court found a prima facie case for temporary protection and considered the risk of continuing loss and dealings with the land. It expressly recognised that weighty ownership questions still needed proof at trial. The interlocutory ruling did not finally identify every beneficiary or complete distribution of the estate.

The judge considered preservation the lower risk while the full evidence awaited hearing. The temporary orders addressed management, rent payments and dealings with the identified properties. They should be read with their duration and purpose, rather than presented as a final award of every remedy requested by the applicant.

An agent was to collect rent for deposit in court

The operative directions provided for a reputable registered real-estate agent appointed by the parties to collect rent and deposit it in court monthly, less the statutory commission described in the order. The respondents were restrained from continued collection and tenants from paying the specified recipients. Dealings with the properties were also restrained pending the suit.

The printed appointment direction refers both to 21 days for appointment and 15 days for failure to agree before the court intervenes. This article does not replace either period with a guessed harmonised deadline. Anyone implementing that direction needs the sealed order and any subsequent clarification.

Past rent was not awarded

The applicant requested recovery of rent said to have been collected from 2013. The judge stated that proper accounts were needed and made no order for that money, indicating separate litigation would be required. The ruling therefore preserved current income without creating a quantified historic-rent award.

Costs of the application were left in the cause. The decision does not show whether an agent was actually appointed, deposits were made or a later hearing resolved entitlement. A current enquiry must check the later file and payment records before assuming the interim arrangement remains unchanged.

Prepare an income record for each property

For practical review, list tenants, leases, agreed rents, actual payments and the person receiving them. Attach receipts, statements and communications. Separate the three properties so amounts and periods can be traced. An aggregate claim covering many years is difficult to assess without the underlying tenancy and collection records.

A property advocate assessing rental income in Kwale also needs the current titles, trust or representative documents and complete succession orders. Explain whether the request concerns authority to manage, preservation of income, accounts or recovery of a proved balance. Each objective raises different evidential questions even when they concern the same buildings.

If a court-appointed or agreed agent is involved, retain the appointment document, commission terms and deposit records. Compare the actual handling of rent with the order rather than assuming payment to any intermediary fulfils it. Identify missing months and disputed receipts without treating them as established losses before the accounts are reviewed.

Does rent deposited in court belong immediately to the applicant?

The preservation direction did not itself finally determine entitlement to distribution. For a new enquiry, provide the order, subsequent directions and the income ledger. This helps distinguish money being secured pending litigation from money already awarded and payable to a particular person under a final decision.
