This article analyses Kenya Orient Insurance Limited v Ramadhan, decided by Garsen High Court.
The insurer regained the opportunity to defend the claim
Garsen High Court allowed the insurer’s appeal and set aside the order striking out its defence in Lamu declaratory proceedings. Disputed policy cover, alleged certificate forgery and notice raised triable questions. A police abstract was rebuttable evidence, not conclusive proof of cover. Appeal and application costs went to the insurer. The ruling did not establish forgery as fact, decide the coverage dispute finally or cancel the underlying accident damages judgment.
Keep the accident and insurance proceedings separate
An accident judgment disputed insurance cover lawyer needs both court files. An advocate should see the underlying accident judgment and decree, then the pleadings and orders seeking payment from the insurer. Identify the defendants in each file and the relief requested. A successful damages claim and a contested insurer payment claim should not be described as the same determination.
Provide any appeal, payment or enforcement record. Explain which order is currently being relied on and which party disputes it. The adviser needs the present procedural position before assessing further steps. Do not assume that a coverage appeal erases the underlying damages judgment, or that the damages judgment answers every question about the insurer’s liability.
Collect the actual policy and certificate evidence
Supply the certificate, policy schedule and correspondence identifying the insured vehicle and relevant period. If you hold only a photograph or copy, say so. A lawyer needs to examine the available evidence of cover rather than rely on the insurer’s name appearing in one document. Include any policy verification already obtained.
Preserve the original disputed certificate and messages concerning its issue. Identify who supplied it and when. An allegation that a document was forged remains an allegation unless determined on the evidence. The advocate needs both the allegation and the material supporting or disputing it to assess preparation for the coverage hearing.
Provide the police record with its limits
Bring the police abstract and any accompanying investigation or vehicle identification documents available to you. Check the registration and accident date against the pleadings. An advocate should understand what the police record states and what independent material supports it. A recorded insurer entry should not be treated as automatically resolving a disputed policy history.
If another version or correction exists, disclose it. Explain where each document came from and retain its full contents. The lawyer can evaluate the record without assuming that a discrepancy proves deliberate falsification. A clear explanation of provenance is more useful than an accusation unsupported by the documents supplied.

Provide every notice sent to the insurer, together with receipt stamps, delivery records and replies. Identify the sender, addressee and date. An advocate needs the actual document and service evidence, especially where receipt or the adequacy of notice is contested. Do not describe a posted letter as acknowledged unless the record supports that statement.
Include correspondence with brokers, vehicle owners or representatives, identifying their role. Messages to one participant should not be silently treated as notice to another. The adviser can assess the service record and the issues pleaded by the insurer while distinguishing established delivery from assumptions about who must have known of the claim.
Prepare for the defence that remains unresolved
Send the insurer’s full defence, the application to strike it out and the resulting appeal orders. Highlight what the insurer denies and the evidence you have addressing each issue. A lawyer needs to understand the specific dispute that requires a hearing. Restoring a defence is a procedural result, not an award that finally determines whether payment must be made.
For consultation, provide the accident judgment, coverage papers, policy evidence and notice trail together. State whether you need assessment as claimant, insured person or another involved party. A lawyer and advocate can review the matter connected to Lamu Law Courts while recognising Garsen as the appellate decision court. This decision explains why the disputed cover required a hearing; it does not guarantee insurer payment or prove that a contested insurance certificate is fraudulent.
