This article analyses Omar v Muhaji, decided by Malindi Environment and Land Court.
The appeal required a new hearing before another magistrate
Malindi Environment and Land Court allowed the appeal, set aside the Lamu decision and consequential orders, and directed a retrial before a different magistrate. The trial court had declined jurisdiction over the plaintiff’s claim while granting the counterclaim. The dispute concerned competing issued titles for a Wiyoni plot. Appeal costs were awarded against the respondents jointly and severally. The appellate orders did not finally decide ownership, authorise eviction or determine which disputed title should survive.
Read the jurisdiction decision and counterclaim together
A duplicate plot titles lawyer needs the judgment, plaint, defence and counterclaim. An advocate should identify what the trial court dismissed, what it granted and its stated reason for declining to hear a claim. A short summary that the entire case was dismissed may conceal an order made on the opposing party’s counterclaim.
Provide the decree and any later directions. Explain whether the decision was appealed, implemented or superseded. The adviser needs to understand the operative position before considering a new filing or a request concerning possession. Do not rely on one sentence from the reasons while omitting the final orders or the other side’s pleaded claim.
Assemble the records for both issued titles
Supply copies of the competing certificates, registry searches, parcel records and plans. Identify when each title was issued and the name recorded on it. A lawyer needs to distinguish a dispute about existing registration from an unresolved request for initial allocation. That distinction should be assessed against the complete documents, rather than inferred from the area’s history.
Include correspondence explaining any withheld certificate, replacement document or administrative correction. Where a committee considered competing claims, provide its full decision and the material you have concerning its authority. The advocate can evaluate those records without assuming that a committee’s recommendation itself settles the validity of every issued title.
Document construction and the present occupation
Provide photographs, plans, agreements and dates concerning construction on the disputed plot. Identify who commissioned the work and who occupies the property. An advocate needs the current facts because the parties may seek directions affecting use of the site while the ownership dispute remains unresolved.
Disclose any allegations that someone acted as caretaker, bought a different plot or occupied by permission. Supply relevant messages and witnesses’ details. Do not collapse these different explanations into a single claim that possession proves ownership. The adviser needs to understand the factual issues a fresh hearing may have to examine.

Send the hearing proceedings, witness statements and exhibits alongside the appeal judgment. Identify records that were admitted, documents merely mentioned and evidence that was never produced. A lawyer should know what the earlier file contains before assessing preparation for the new hearing. A retrial direction does not fill missing evidentiary gaps.
Check the condition of original documents and keep legible copies in a chronological folder. Explain whether a witness is unavailable or a record has changed since the first trial. The advocate can consider how those developments affect preparation without assuming that the appeal has already resolved the facts in your favour.
Confirm what the appellate orders actually require
Provide the direction identifying the new hearing and any subsequent allocation or mention notice. State whether the file has returned to the trial station and whether a hearing date has been issued. An advocate needs the actual administrative and court record before advising about attendance, filing or compliance.
For consultation, send the competing titles, trial file, appeal orders and current occupation history together. Explain whether you need review of the jurisdiction ruling or preparation for the directed retrial at Lamu Law Courts. A lawyer and advocate can then assess the available record. The Omar outcome reopened this dispute for determination; it did not award the plot to the appellant or establish that every duplicate title dispute must follow the same procedural route.
