This article analyses Republic v Chief Magistrates Court Makadara Law Courts & 2 others; Muriithi & another (Exparte Applicants); Kent Estates Limited (Interested Party), decided by Milimani Environment and Land Court.
Existing preservation orders were central
The Muriithi judicial review concerned Makadara criminal proceedings linked to ownership of two parcels already disputed in an ELC suit. The Environment and Land Court at Nairobi considered the existing preservation orders and the ownership issue still pending. It quashed the specified criminal proceedings and prohibited that prosecution over the identified ownership dispute. Each party was to bear its own costs.
This did not determine final ownership or declare that every criminal complaint connected to land is unlawful. The practical issue is an alleged conflict between a live land preservation order and a particular prosecution, supported by the actual record.
Obtain the preservation order and underlying file
A land status quo dispute lawyer needs the complete ELC order, pleadings and latest directions. Identify the parcels named and the persons bound using the wording of the documents. A general statement that a court protected the land may omit limits on possession, transfer or the duration of the direction.
Keep any later variation or discharge with the original order. An advocate cannot assume that an old preservation direction remains operative merely because it appears in a historical judgment. Explain the current stage of the ownership case and provide the most recent record available.
Map the criminal allegation to the land dispute
Supply the charge sheet and the complaint material available to you. Identify the alleged act, date and property involved, keeping those allegations separate from final findings. A charge connected with a parcel may raise a different issue from the competing claim to own it.
Prepare a chronology linking the preservation order, transactions and commencement of criminal proceedings. Attach the documents supporting each event. If a transfer is said to have occurred contrary to an order, provide the order and registry record rather than treating the allegation as already proved by another case's outcome.
Preserve ownership and transaction records
Collect the available title, search, grant or transfer documents privately. Label a historical search by its date and do not treat it as a current registry position. Where several parties claim through different transactions, show the competing chains separately so the reviewing advocate can identify the issue.
Keep disputed documents in the form received. A disagreement about authenticity requires the actual document and its history, not a recreated version. Identify any expert report or earlier finding already made without assuming that every question about the title was finally resolved by an interim order.

State whether the immediate concern is the criminal proceedings, compliance with the preservation order or determination of title. These issues may intersect without becoming one interchangeable remedy. A quashing order concerning a prosecution should not be described as registration of ownership or automatic possession of the property.
Provide any application already filed and the response to it. The advocate needs to know which court was asked to do what, including any objection to jurisdiction. The Muriithi order was limited to the identified case and parcels; it does not justify omitting the specific facts of a new matter.
Document the current position after an order
If relief has already been granted, supply the extracted order and any registry or prosecution response. An order's existence and its implementation are separate records. Keep any later notice, appeal or new charge in the chronology rather than assume the publication describes the final present position.
For advocate review linked to Makadara Law Courts, provide the criminal file, land preservation directions, ownership pleadings and current dates. Explain the alleged conflict with evidence. The reviewing lawyer must distinguish the particular prosecution from the unresolved civil ownership question and assess the scope of every operative order.
Muriithi demonstrates judicial intervention in the circumstances of that record. It does not prove ownership for another party or promise that land-related charges will be quashed. The article is a source-based example for a focused consultation, with legal allegations and actual judicial findings kept separate.
