If you need a legal aid request and fair trial on appeal lawyer or advocate for a matter connected to Makadara Law Courts, Nairobi, start with the actual orders and documents. This article analyses Wakhungu v Republic, decided by Milimani High Court — Criminal Division.

The court examined what happened after the request

Wakhungu appealed a Makadara conviction, raising lack of legal representation and other fair-trial concerns. The High Court judgment records that the trial magistrate directed him to apply to the Legal Aid Committee and adjourned the hearing. It rejected the fair-trial challenge and upheld conviction, while separately replacing life imprisonment with ten years and addressing remand credit.

That historical assessment is not a current eligibility test for every legal aid applicant. It does not mean a person facing serious charges should never seek funded representation. The focus is documenting a request for assistance and the actual trial response before seeking advocate review.

Preserve the request and response

A legal aid and fair trial lawyer needs the record of the request made in court and the resulting direction. Identify the date and the words recorded where available. A recollection that help was refused may differ from a direction to apply elsewhere or an adjournment allowing that step.

Keep any written application, acknowledgement and decision from the relevant service with the court record. If no response was received, state that position. The advocate needs to distinguish a request not yet determined from a formal refusal and to understand what information accompanied it.

Explain the representation history

List periods when an advocate acted and periods when the accused was unrepresented. Supply notices of appointment or change where available. Representation at one hearing does not establish that assistance was available throughout, while an initial absence of counsel does not describe every later stage.

Identify the immediate question privately with the reviewing lawyer. It may involve obtaining assistance now or assessing the effect of an earlier recorded event. This article does not decide eligibility, recommend a plea or select a defence strategy. Those matters require the current charges, circumstances and instructions.

Build the relevant hearing chronology

Provide the proceedings showing adjournments, disclosure and examination of witnesses. Mark the hearing or application said to have been affected by the representation concern. A broad label of unfair trial should be supported by the specific event and record the advocate is asked to examine.

Keep any difficulty understanding a direction separate from a disagreement about the eventual verdict. Supply interpretation records or other relevant documents where available. A lawyer needs enough context to assess the concern, including the opportunity recorded for participation and the consequence you say followed.

Keep conviction and punishment separate

Supply the trial judgment, sentence and appeal order. Identify whether the current concern involves guilt, the sentence or another procedural direction. Wakhungu's conviction remained in place despite the sentence change, so the judgment should not be described as an acquittal or complete reversal.

Where sentence computation is also relevant, provide custody and bail dates using official records available to you. The historical ten-year term is not a universal substitute for another sentence. An advocate must assess the current operative order and later developments before examining punishment or credit.

Prepare a focused consultation

For review connected to Makadara Law Courts, submit the legal aid request, response, relevant proceedings and latest order. State whether there is an upcoming hearing or a concluded trial, with the date from your own file. Mark missing records instead of treating them as proof of an event.

Wakhungu illustrates the court's assessment of that request and trial record in 2023. It does not settle present legal aid eligibility for another person or guarantee an appeal outcome. A lawyer or advocate should examine the actual application, recorded response and alleged consequence before advising on the current issue.

The practical guidance here helps organise a consultation record. It does not replace advice about a current entitlement or application process, which should be checked against the law and responsible service at the time assistance is sought. Keep private financial and personal information within the confidential review.
