Looking for a lawyer or advocate for business refund for money sent through a relative at Malaba Small Claims Court? This guide explains Wambui v Shiranda and the documents to prepare for an independent consultation.

The payment record did not prove the full business debt

The Kshs.84,000 claim was dismissed because cash and third-party transfers were not sufficiently connected to the pleaded debt. The counterclaim succeeded only for Kshs.6,000, with Kshs.3,000 costs on each claim. A transfer record did not, by itself, establish the purpose or entitlement asserted in the suit.

Explain the business arrangement before listing transfers

A lawyer for recovery of business money needs the agreement, messages and documents explaining what the recipient undertook to do. An advocate should identify who contracted, who provided funds and who expected the benefit. Keep an investment proposal separate from a loan or an agreement to refund. The same transfer may be described differently by the parties, so preserve their actual communications.

Prepare a concise chronology of the arrangement and the point at which the refund was requested. Attach any acknowledgement or response. Identify the obligation you say remained unperformed rather than assume that an unsuccessful business venture automatically creates a debt. This guide decides no reader’s contract; consultation should establish the legal and factual basis of the demand before calculating an amount to claim.

Trace money sent by another person

Bring the sender’s statements and the communications explaining why that person made the transfer. A lawyer needs to understand whether the sender acted for you, contributed independently or made an unrelated payment. Identify which facts you know personally and which require an account from the sender. A family relationship alone does not explain the purpose of every transaction appearing in another person’s statement.

An advocate should compare each transfer with the alleged agreement and recipient’s response. Keep instructions, acknowledgements and references linked to the relevant entry. Preserve the original statements instead of relying on isolated screenshots stripped of surrounding transactions. This preparation supplies no finding that the money belonged to you or that another person’s transfer can be recovered in your name; those questions require examination of the actual evidence.

Document cash payments separately

Record the amount, date, place, recipient and available acknowledgement for each alleged cash payment. A lawyer should know whether there is a receipt, witness account or contemporaneous message. Label a recollection as such and do not convert it into a documentary fact. If the other side admits receiving some cash but disputes its purpose, include the admission and the disagreement together.

An advocate needs to assess the evidence actually available for the cash component. Avoid filling a difference between the claimed total and proved transfers with an unexplained cash figure. This article does not declare that cash can never be proved. A consultation should identify reliable support and gaps without inventing a receipt or assuming that an undocumented amount will necessarily be accepted.

Keep refunds and alleged overpayments in the same ledger

List payments received back and link them to the relevant transaction where possible. A lawyer should see acknowledged refunds even when your preferred claim is for a larger amount. Keep a settlement proposal separate from money actually received. Explain any dispute about whether a repayment relates to this arrangement or another obligation between the parties.

An advocate also needs a counterclaim, response and supporting schedule if the other party alleges overpayment. The original claim and the counterclaim require their own evidential explanation. Do not assume that failure of one automatically proves the other. This guide calculates no excess payment for a reader; a full ledger allows both asserted balances to be examined using the same underlying records.

Match the filed claim to the evidence of entitlement

Bring the statement of claim, defence, counterclaim and exhibits. A lawyer reviewing a live case or judgment should identify the amount pleaded and the evidence connecting each component to an obligation owed to the claimant. Mark documents not filed separately from those in the court record. Include the judgment and any later order where the matter has already been decided.
