Looking for a lawyer or advocate for unpaid cattle agreement and proof of cash value at Malaba Small Claims Court? This guide explains Ekirapa v Omilia and the documents to prepare for an independent consultation.

The monetary claim failed because value was not established

The court treated the undertaking to provide five cows as binding but dismissed the Kshs.600,000 monetary claim for lack of valuation evidence or an agreed pricing mechanism. It assessed Kshs.2,000 costs. A proved undertaking did not establish the cash figure sought, and the court did not award delivery of cattle.

Read the promised performance in the agreement

A lawyer for an unpaid cattle or goods undertaking needs the signed document and communications explaining its terms. An advocate should identify whether the promise concerns delivery of particular goods, cash payment or an alternative. Keep a later proposed conversion to money separate from the original agreement. The remedy you prefer may depend on facts beyond proof that an undertaking was signed.

Explain who made the promise, who was to receive performance and any connection to an earlier transaction. Preserve a disputed account of that background rather than treat it as agreed. This guide determines no reader’s contractual obligation. A consultation should establish the actual parties and terms before assuming that a promised number of animals creates a debt for a price selected afterwards.

Identify the goods with the detail available

Collect descriptions, correspondence and records identifying what was to be supplied. A lawyer should know whether breed, age, condition or quality was agreed, left open or later disputed. Mark a description added after the agreement separately from its original wording. If the goods were individually identified, preserve the records showing that identification rather than substitute a general market description.

An advocate needs to assess the available detail before discussing performance or money value. Avoid filling omissions in the agreement with a description favourable to your preferred price. This article prescribes no animal quality and values no reader’s goods. Preparation should show the actual promise and uncertainty so the adviser can consider an appropriate evidential basis and remedy without inventing contractual terms.

Support a monetary demand with a traceable valuation

Bring any valuation, relevant sale records, quotations or other material supporting the amount you propose. A lawyer needs to know who supplied the figure, the goods it describes and the date to which it relates. Keep an asking price separate from a completed sale. State any limitation in the comparison rather than treat every quoted price as proof of the promised goods’ value.

An advocate should compare that material with the agreement and the remedy pleaded. A multiplication of the number of animals by an unsupported estimate does not explain why that unit value was selected. This guide does not guarantee that a particular report or quotation will be accepted. Consultation should identify what can be reliably established and what further evidence, if appropriate, may be needed.

Preserve the demand and response on non-delivery

Collect reminders, notices and replies dealing with performance. A lawyer should identify whether delivery was refused, delayed, disputed or proposed on conditions. Keep an offer of goods separate from evidence that the offer was accepted or fulfilled. Record any partial performance and its acknowledgement. Explain the immediate problem using the documents rather than only a statement that the promise was never honoured.

An advocate also needs communications about replacing the promised performance with cash. Mark a unilateral demand differently from a mutually accepted variation. This article authorises no taking of livestock or other property to satisfy the alleged obligation. Advice should address the actual agreement, conduct and current court position before any practical recovery step is considered.

Compare the requested remedy with the filed record

Bring the claim, defence, witness material, exhibits and any judgment. A lawyer should know whether the case sought delivery, a particular cash amount or another form of relief. Identify the evidence presented for that remedy and the reason given if it was declined. Keep a procedural challenge separate from disagreement with the valuation finding itself.

An advocate needs to assess the current position and any lawful further route from the actual order. This guide neither reopens a dismissed suit nor supplies a filing period. If the undertaking and monetary proof received different treatment, preserve that distinction in your consultation account instead of summarising the case as complete success or total invalidity of the agreement.

Request “Malaba unpaid cattle undertaking — lawyer and advocate for cash-value evidence and remedy review”. Share the agreement, goods description, valuation material, demand correspondence and court papers privately. State the specific relief you need assessed. Ask about the proper court, evidence, fees and possible costs. The cited decision determines no livestock value or recoverable sum for your own dispute.
